MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met May 18, 1977, <br />at 7:30 P.M. Members present were: Raymend House, Steve Edwards, <br />Paul Walters and Eweather Stephens. Attorney David Lawson was <br />also present. Due to a conflict of interest relating to one of the <br />petitions to be heard, Steve Edwards disquallfied himself and asked <br />that he be replaced fo~ this meeting by another member of the Plan <br />Commission (the governing body of which Steve is a representative <br />on the Board of Zoning Appeals). By unanimous vote the Board of <br />Zoning Appeals asked Willlam Abbott to replace Steve Edwards for <br />the meeting of May 18, 1977. <br /> <br /> In Edwards absence the meeting was called to order by Vice Pres- <br />[dent Paul Walters. <br /> <br />The Minutes of the previous meeting were approved as read. <br /> <br /> Docket #3, 1977, was presented by Attorney James G. aJ~.L[Lfor his <br />clients, william Asher of ,2,0 E~ H~rrison Street, Mortinsvilie, Ind. <br />Connie Haven of 28869 Kehres , Elkhart, Ind, and Lyla Thomas of <br />1210 E. Harrison Street, Martinsville, Ind. <br /> <br /> The petition,as published, requested a variance for property <br />at 132 W.-Harrison 5t~ in Moor&sville, from residentlal A, s~ngle <br />(amily to a multiple family dwelling. Attorney Lawson explained <br />that would involve re-zoning and would fall under the jurisdiction <br />of the Plan Commission. <br /> <br /> Lyla Thomas explained there had been a misunderstanding; what <br />she and William Asher were seeking is to have two apartments in the <br />dwelling, thus allowing William Asher, as life-tenant, to occupy <br />one of the two apartments during his flfetime, and the other to be <br />rented and provide an income for the lifetime of Willlam Asher. <br /> <br /> Attorney Mains requested an oral change of the petition to <br />ask for a variance from Residential A, one family to Residential B, <br />t~e family, with the restriction that the variance be restricted <br />to the time during which William Asher maintains his residence at <br />132 W. Harrison St. After discussion between Attorney Mains and <br />Lyla Thomas, who acted as spokesman for William Asher, it was <br />agreed that the petition could carry the restriction. <br /> <br /> Remonstr~to~s~E~presented by Attorney Ralph Lett who <br />presented a I,st~o~F?~.l?~6~concerned w~o ~ad si~n~d petitions <br />objecting to the published petition; ~n ~ts or~gmal form. <br /> <br /> Those people speaking to their concerns, who identified <br />themselves, were: Glendolyn Ferguson, W. Harrison St., Helen Hart, <br />121W. Harrison, John White, 124 W. Harrison St., Bill Ruona, 166 <br />W. Harrison St., and Boyd Head <br /> <br /> Once the petition was orally changed and clarified and <br />remonstrators were assured that only two apartments were intended <br />and that William As~Jer wooed in fact be residlng~bne of the ~two <br />apartments, for his lifetime, the remonstrators agreed that if the <br /> <br /> <br />
