become a parking lot. ,He spoke of disturbing night park!ng from
Tavern Patrons, when T~ompsonms Auto is not open for business.

Attorney Hills in cross-examination pointed out that Hr. Wissner
is an Indianapolis resident who was aware of the operations of a
garage on the property, which was in violation of Zoning Ordinances.

Attoeney Currens in summary noted that traffic in the alley was
present, due to 1ack of dc~vntown parking space, before Thompson Auto
installed the slx parking spaces on the cement slab and dldnmt feel it
had created an additional traffic hazard.

Robert York indicated that the present garage as seerage space
and the existing six parking spaces was not undesirable. Attorney
Currens indicated agreement to a variance affecting only the garage
for storage and parking spaces.

Attorney Hllls,'in sui~ary, indicated that a lack of feeling, on
the part of Mr. Wlssner for the residents was apparent, as his, Wissners
interests in the area are purely business.

Having heard all interested parties, the board members retired to
another room to fully discuss th~ propose~ variance an~ to weigh the
evidence. After full consideration and v~sualiy checkmg the property
in question, the Board found that =

1. There are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use that do
not.a~piy genera]]y to the other property or class of use in the same
vicinity and District.

2. That such variance is necessary for the preservation and en-
joyment of a substantial p~operty right ~ossessed by other property in
the samevicinity and D~str~ct but which ~s denied to the property in
question.

3. That the granting of such variance will not be materially
detrimental to the public welfare or injurious to the property or
improvements in such vicinity and District in which the property is
located.

4. That the granting of such variance will not alter the land use
characteristics of the vicinity and District, diminish the marketable
value of adjacent land and improvements or cause or add to traffic
congestion in the public streets.

Upon returning to th~ meeting room it was announced that the
Board had after full cons~deration, passed, unanimously, the following
motion as made by Steve Edwards and seconded by Warren Franklin:

A variance be granted to Thompson Auto Supply, Inc. on the existing
parking area consisting of a concrete slab, approximately 30~ x 45~
in size, on the North end of lots 14 & 15 at 18 W. Harrison St. Further,
that a variance be granted to Thompson Auto & Supply, Inc. to use the
existing garage on the North end of lots 14 & 15 at 18 W. Harrison St.
for storage conditioned on the following:

!. She South door shall be permanently sealed.
