MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met on May 27, 1976, at <br />8:00 P.M. Members present were: Paul Walters, Warren Franklin, Steve <br />Edwards and Eweather Stephens. Also present was Attorney for the <br />Board, Oavld Lawson. <br /> <br /> Minutes from the previous meeting of May 11, 1976 were read and <br />corrected to reflect that abe continuance was filed by Attorney John <br />Mills in behalf of his client, Mr. S.H. Richer, remonstrator to the <br />proposed petltion seek~ag a variance to property at 18 W. Harrison St. <br /> <br /> Oocket #2, 1976, amended May 20, 1976 was presented by Attorney <br />Tim Currens in behalf of his Cllent Thompson Auto Supply, Inc.. Mr. <br />John Wissner.appeared for Thompson Auto ~upp1¥, Inc. The petition ask- <br />ed for a variance to ~resent zonSng, resldenttal Aj for property <br />located at 18 W. Harrison St., lots 14 & 15, to allow Thompson Auto <br />Supply, Inc. to use the garage, located on the Northwest corner of said <br />property, for storage area , and the North end of said property as <br />customer parking space. Mr. Wlssner indicated that presently plans <br />were to continue renting the house on the front of the property. <br /> <br /> Warren Franklin, Street Co~nlssioner, pointed out that the cement <br />slab that is already being used for parking, on the North end of the <br />property at 18 W. Harrison St. was poured without benefit of a variance· <br />Mr. Wissner indicated that he had been granted permission to pour the <br />slab by the Clerk-Treasurer, but when made aware of a vlolation of <br />Zoaing Codes he took steps to conform by seeking the variance. <br /> <br /> Atto, ney John Mills, representing remonstrators present asked of <br />Attocney Currens wheeber or not the petition is for all of the property <br />at 18 W. Harrison St. Currens answered "yes", but that present plans <br />were for use of the back portion of the lotso(14 & 15). <br /> <br /> Three.spokesmen for the remonstrators present were as follows: <br />Mr. S.H. Richer, of 31W. Harrison St~poke to the concern of small <br />children now in the 1st block of W. Harrison St., (15 small children), <br />and the traffic hazard that a parking lot would create in what is4, <br />predominantly[resldent~al area. He,llke ail those residents present <br />wp~ld like their neighborhood to remain residentlal. He pointed out <br />that the business which exists in the neighborhood was present before <br />Zoning laws were enacted to prevent the further erosion of residentaal <br />property· A petition bearing 65 signatures of residents and property <br />owners of the area in question, was presented by Mr. Richer. <br /> <br /> The Second speaker was Mr. Robert York of 47 W. Harrison St. He <br />spoke as an appraiser of Real Estate, by profession. He pointed out <br />that generalizations as to how eesidential properties will be affected <br />by the appearance of business cannot be made. Each case must stand on <br />its own merit, depending en the type of business. In some instances <br />property values are enhanced, in others property values decrease, caus- <br />lng dlffaculty for prospective buyers to secure financing. <br /> <br /> The third speaker was Mr. Claire Cook of 30 W. Harrison St, the <br />property adjoining to the West, the property under consideration for <br />the variance. His concern was of letters to property owners which <br />seemed to conflict with the notice published in the paper. He sought <br />answers as to whether the entire property at 18 W.
