MOORESVILLE BOARD OF ZONING APPEALS <br />FINDINGS OF FACT <br />FOR VARIANCE OF USE <br />Pursuant to IC 36-7-4-918.5, the Mooresville Board of Zoning <br />Appeals having heard the Variance filed by Core Fitness Club, LLC <br />at the meeting held March 9, 2017, regarding the real property <br />located at 241 S. Madison St., Mooresville, Indiana, Parcel No. <br />55-01-36-265-001.001-005, Part of Lots 11-15, DeWitts Subdivision <br />(100' off South end) Exc 30' off East side Lot 15, requesting a <br />variance from the Mooresville Zoning Ordinance to allow use as an <br />impound storage lot to serve Mooresville Police Department and <br />Morgan County Sheriff's Department and related law enforcement <br />agencies, now finds: <br />1. The approval will not be injurious to the public <br />health, safety, morals and general welfare of the community for <br />the following reasons: it is appropriately buffered and it is in <br />a commercial setting. <br />2. The use and value of the area adjacent to the property <br />included in the variance will not be affected in a substantially <br />adverse manner due to the following: the location is in a <br />commercial area, would be appropriately buffered and would access <br />off the State Highway. <br />3. The need for the Variance arises from some condition <br />peculiar to the property involved, namely: it is on a State <br />Highway and has access from an additional State Highway. <br />4. The strict application of the terms of the Zoning <br />Ordinance will constitute an unnecessary hardship if applied to <br />the property for which the Variance is sought, namely: the <br />location on the property on the State highway and the particular <br />use with the restrictions added would limit and place an <br />unnecessary hardship on the proposed use of the ground. <br />
