Jeff Dieterlen <br />asked for some wording change so that the amendment and the <br />covenant would match, he then confirmed that written concerns <br />presented in December from outside agencies had been addressed. <br />Tammy VanHook asked if the road concerns discussed in the <br />previous meeting had been addressed, yes steps are being taken to <br />turn the road over to the county. Mr. Young called for questions and <br />or comments from the audience. Charles Anderson of Departure Blvd <br />reminded the board of concerns from the previous meeting; Jeff <br />Dieterlen asked if most of his concerns had since been addressed. He <br />stated yes, however there was question as to whether or not the <br />homeowners association needed to seek legal counsel to ensure the <br />changes being requested are in the best interest of the residence. Mr. <br />Dieterlen responded by stating that the requested changes seem to be <br />an improvement, Mr. Anderson also questioned if the homeowners <br />were to have voted in or on any impending changes, as Mr. Swinney <br />is still the majority property owner a homeowners association vote <br />was not necessary. Karen Bea � of Tower Court stated that Mr. <br />Swinney had been more than_'o�gand requested a favorable vote. <br />Brian White of Departure Blvd., President of the Homeowners <br />Association appreciated the idea of the rewording as discussed earlier <br />and discussed the necessity of an attorney. Ray Lundy, having built 3 <br />homes in North Madison Crossing with a 4ffi in the works stated he'd <br />never had issue with Mr. Swinney. In closing Mr. Swinney stated that <br />the original covenant and restrictions were not as restrictive as the <br />ones presented tonight, he himself had built better than required, <br />having said that he did not wish to seek any further negotiations and <br />should the amendment not pass this evening he would simply retain <br />the development and construction standards currently in place.
