south of Main St. and West of Monroe St. from residential to B3 with a stipulation for library use <br />only. The reason for that is because that is the appropriate zoning for a library of that size of <br />building. They will be requesting the Town Council to vacate the alley between the two <br />properties on west and north. The library is fully aware that they will have utilities to relocate <br />and they might even have to give back some easements. <br />Commissioner Bryant asked if the stipulations would hold up on the property. Mr. Holloway <br />stated that up until two years ago the Indiana statute would not allow stipulations and conditions <br />on zoning. Then the state changed the statute to allow restrictions and conditions on zoning and <br />Mr. Currens has allowed this board to do that the last two years. They are enforceable and they <br />go with the land, 100 years from now it would still be a library or they come to this board or the <br />zoning body and ask for it to be lifted. <br />Commissioner Bruner said his only concern was they do not have the storage problem they have <br />now. <br />Commissioner McGuire stated that he is all for the library expansion, but it seems like we will <br />have another situation if come before the Town Council for the vacating of the alley and the <br />council does not pass the vacating of the alley. The board would not want a zoning of B-3 on <br />that side of the Main Street if they don't get access to build the library there. Mr. Holloway said <br />the library would agree to the stipulation of the rezone on the vacating of the alley. <br />Motion to send a favorable recommendation to the Mooresville Town Council to approve the <br />rezone of lots 16,17,18,19,20,21,22,23 and a large meets and bounds property south of Main <br />Street and West of Monroe Street known as the Jessup property from residential to B-3 with two <br />stipulation, one the Town Council approve the vacating of the alley and the rezone is for library <br />use only, was made by Commissioner McGuire, second by Commissioner Corbin. Motion <br />carried 7-0. <br />Mr. Beikman reported he had issued 16 permits and had 57 inspections. <br />Next Commissioner Crouch asked about the person on the north side of State Road 144 still <br />selling car. He said he had not had a report back. Mr. Beikman said that the meeting before last <br />it was not a conforming use and there are two different houses there, one on each side, and now <br />are we going down State Road 144 an tag everyone who is selling cars. Mr. Crouch said he has <br />about seven or eight cars out there. Mr. Beikman asked if they were there now and Mr. Crouch <br />said they were. Mr. Young said we should continue to monitor the situation and if it gets out of <br />control, maybe they could address it then. <br />Commissioner McGuire gave all the board member present copies of the Martinsville Zoning <br />requirement and new copies of the Comprehensive Plan. He would like for everyone to look <br />over the Martinsville copy and Mooresville copy of zoning restrictions and look at the layout. <br />Mr. Young said the theirs was a much better format and start marking them up as to what <br />changes they would like made. <br />There being no further business a motion to adjourn was made by Commissioner Bruner, second <br />by Commissioner Corbin. Motion carried 7-0. <br />
