Council was made by Dennis Chambers, seconded by Dave Moore <br />and passed unanimously. <br />The next item on the agenda is rezone request at 5657 E. State Road <br />144. The current zoning is B2 and the request is for B3. Attorney <br />Dale Coffey representing Tricia (Richhart) Price previously presented <br />the property and currently operating landscape business to the Board <br />of Zoning appeals requesting a variance, however withdrew the <br />request to seek the rezone. Mr. Coffey explains that the area <br />surrounding the property has a mixed use: residential as well as a vet <br />clinic, church and convenience store all nearby and that the <br />landscaping business is a good fit for the area. The Commission <br />members and property neighbor discussed and questioned the hours <br />of operation, the noise of equipment, the bright lights as well as <br />outside objects in and around the storage units also on the property. <br />Mike Young stated no one attended the Tech Review on behalf of the <br />applicant. Joe Beikman questioned if minor plats were on file, Mr. <br />Coffey was unsure. Tammy VanHook questioned the sign on the <br />property indicating auto service was coming soon, she was told that <br />was not on this property or owned by these individuals. The <br />residential neighbors provided photographs of the property and <br />landscaping business. Jeff Dieterlen discussed the option of <br />approving with restrictions, and after multiple breaks to discuss <br />options Mr. Coffey stated his clients were willing to agree to some <br />limitations but were only willing to go and financially do so far. Mr. <br />Coffey then requested a continuance; Mike Young stated they may <br />wish to attend the next Tech Review. Joe Beil man made the motion <br />to allow the continuance, Perry King seconded it and the motion <br />passed. <br />The next item on the agenda is a request to favorably recommend a <br />rezone of lots 19 and 20 of Flagstaff Business Park from PUD -C to <br />PUD -I presented by Jeff Banning of Banning Engineering on behalf <br />of J & J Commercial Investments. Mr. Banning explained that the <br />surrounding area is PUD -I so there would be consistency and that <br />
