variance verses a rezone was made, as only the one entity would need <br />the adjustment, not the entire building. It was stated by Mr. Niemier that <br />the proposed plans were for a 12 -year deal. When no further questions <br />were asked Mike Young called for a motion: Charles McGuire made the <br />motion to accept, with the stipulation that it only be allowed in the <br />specified suite, Perry King seconded the motion and the motion passed <br />3-0. <br />The next items were presented together: a special exception and variance <br />request for 390 N Monroe Street. Ross Holloway presented the requests <br />on behalf of Edward Owen. The requests are special exception to allow <br />overnight kennel boarding in a B3 zoning and a variance for lot area less <br />than 3 acres. Mr. Owen recently had his indoor dog park approved, his <br />business has been up and running since March of this year. It was <br />discussed that the indoor facility has not raised any noise concerns <br />during day time business hours, Mr. Owens does not believe noise will <br />be a problem in the overnight as well. The request is to allow up to 10 <br />dogs overnight, Mr. Owens states that as they will not be caged the <br />typical kennel barking should not be an issue. Members of the board <br />continued to express concern for noise. Attorney Mel Daniel suggested <br />the business owners be required to report back in 60 days and present <br />any complaints. Tim Bennett questioned who would address the noise <br />complaints. When no further questions were asked Mikc Young called <br />for a motion on the variance Charles McGuire made a motion to approve <br />the variance, Perry King seconded that motion and the variance passed <br />3-0, Charles McGuire then motioned to allow the special exception with <br />the stipulation that the noise complaint report be required in 60 days, <br />Perry King seconded the motion and the motion passed. <br />When no new business was presented Perry King made a motion to <br />adjourn, Charles McGuire seconded the motion and the motion carried. <br />
