December 1, 2020 <br />The Mooresville Town Council met in regular session on Tuesday, December 1, 2020, at 6:30 P.M. at the <br />Mooresville Government Center. <br />Council members present were Council President Shane Williams, Councilman Dustin Stanley, <br />Councilman Tom Warthen, and Councilman Jeff Cook. Councilwoman Jessica Hester resigned on <br />November 18, 2020. Town attorney Cha-il Lee was present. <br />Councilman Dustin Stanley gave the prayer. <br />Councilman Warthen made a motion to approve the minutes of the November 17, 2020 meeting and <br />was seconded by Councilman Stanley, Motion Carried 4-0 <br />Unfinished Business: <br />Employee Policy Handbook - There has been a joint effort between committee members: Councilman <br />Williams, Councilman Dustin Stanley, Clerk -Treasurer Dianna Wamsley, Deputy Clerk Debbie Monts, and <br />Waggoner, Irwin, Scheele & Assocates, LLC to update the employee handbook. Kim McKenzie and Lori <br />Sellen from Waggoner, Irwin, Scheele & Associates, LLC joined the meeting via Zoom. Lori shared an <br />update on the process and the draft before the council was put together. <br />Section 2.1 Recruitment— When a full or part-time vacancy occurs, the Department Head shall request <br />that position be filled by the Town Council. Councilman Warthen made a motion to accept the language <br />of section 2.1, and Councilman Stanley seconded. Motion carried 4-0 <br />Section 3.10.3 Overtime Compensation and Compensatory Time- There was some discussion about the <br />current maximum hours of comp time accrual. Councilman Warthen asked about doing away with the <br />comp time and paying out overtime. Councilman Cook voiced his disagreement with doing away with <br />comp time. Councilman Cook made a motion to keep the comp time structure as -is with a second from <br />Councilman Warthen. Motion Carried 4-0 <br />Section 4.1 Vacation - There was a discussion about splitting up the allocation of vacation time semi- <br />annually and the pros and cons of changing the timeline on which vacation time is awarded. Councilman <br />Warthen motioned to award the vacation time on a semi-annual basis and seconded by Councilman <br />Stanley. Councilman Williams and Councilman Cook opposed. Motion passes 3-2 with Clerk -Treasurer <br />casting the deciding vote. <br />Councilman Cook expressed his concerns with moving forward, making decisions on the handbook <br />without discussing with the department heads. <br />Steve Eltzroth, Mooresville Police Department, asked if these policies had been reconciled with the <br />Indiana Code and SOP of the police and fire department hours and regulations. Consultant Lori Sellen <br />said that there is a lawyer that does conform the handbook with those regulations. President <br />Councilman Williams stated the employee handbook is only related to employee benefits. <br />Councilman Cook made the motion to table this issue until the next meeting. There was no second. <br />Section 4.21 Police and Fire Department Holiday Hours - It was proposed that the Holiday hours be <br />awarded to the Police and Fire departments quarterly rather than at the first of the year. Councilman <br />Warthen made a motion to approve section 4.21 as proposed. Councilman Stanley seconded. <br />Councilman Cook opposed. Motion carried 3-1 <br />Section 4.4. Sick Leave - Currently, there are no limits to sick leave days that can be carried over. There <br />is a question if there needs to be a limit on the carryover hours. Councilman Warthen voiced that <br />employees should not be worried about the amount of sick time they have if they are sick, and it should <br />not be limited. Councilman Cook asked about the ability to donate sick time to another employee, but it <br />was determined that it could not be done under the current draft. Councilman Warthen made a motion <br />to keep the current policy on sick days carrying over. Councilman Stanley seconded. Motion <br />Passed 4-0 <br />
