Mooresville Planning Commission, January 8, 2021 <br />for the Mooresville community. Mike Dellinger asked for the support and approval of the resolution. Nice -Pak <br />has committed that they will start work in March for completion by June of 2021. Kimberly Schofield asked why <br />the project was expanded. Mike Dellinger replied that life has changed and there is significant opportunity in the <br />pandemic to expand operations. Nice -Pak committed to expansion on the 100 acres of the Poly (?) farm which <br />was originally purchased by the RDC. Nice -Pak will retain the building they currently inhabit. Kimberly <br />Schofield asked what will happen to the old facility. Mike Dellinger reiterated that they would maintain <br />operations in the older buildings and added that Nice -Pak came to Morgan County in 1974 and will survive this <br />pandemic. Mike Young stated that if the Resolution was approved by the Planning Commission it would go to <br />the Town Council. First, he called for a motion on the approval of the Resolution. Kimberly Schofield motioned <br />to approve the resolution with a favorable recommendation to the Town Council. Perry King seconded and the <br />Resolution was approved unanimously. <br />Next on the agenda was a request to rezone a plat at the SW corner of Pennington Road and Dayhuff from <br />agricultural to residential to divide the parcel into 4 lots for residential development. Mike Huter of <br />Recommended Land Surveying, Inc. stated that Jack Geen, owner of Green LTD Partnership requests the <br />rezoning of a plat at the Southwest corner of Pennington and Dayhuff. It is currently 43 acres zoned agricultural <br />which drains North to Southeast to the creek. There are currently two drives offering access to the property, one <br />off Dayhuff Road and the other off Pennington Road. Soil samples submitted to the Morgan County Health <br />Department and they recommended on-site sanitary. An additional 50 feet were added to Lot 3 (on submitted plat <br />map). Proposed well sites have been added to the drawing (not submitted to the Planning Commission) and <br />primary and secondary septic easements. Jeff Deiterlen stated that Lot 2 is an existing home with an existing <br />garage currently under renovation. He stated that there should be an existing well and an existing septic field, but <br />the engineer could not find the well. He asked how confident the petitioner was that a well exists on Lot 2. <br />Randy German of German Engineering addressed the Planning commission and stated that the well may be in the <br />basement of the house, and that the finger system and septic on Lot 2 were still operable. Jeff Deiterlen then <br />pointed out that if the well existed on other lots, there may be issues. Randy German stated that water issues were <br />reported in the basement of the home, thus he was "pretty certain" the well was in the basement. Kimberly <br />Schofield asked about runoff and environmental impact if the creek into which drainage was reported was a <br />tributary into another body of water. Mike Hater stated that local drainage ordinances prohibit draining solids <br />into the creek. Randy German stated that "There is good drainage in that area" and that all soil erosion covered <br />under Rule 5 so that all drainage must be intercepted before the creek. He also stated that there is limited <br />potential for hydrocarbon runoff; all drainage should be less than .3 gallons per day per square foot on the septic. <br />All erosion and runoff issues will be taken care of under plans put in front of the Planning Commission. Mike <br />Young called for a motion; Jeff Deiterlen motioned to accept the plan as presented and Perry King seconded. The <br />plan was accepted unanimously. <br />Next on the agenda was the approval of the creation of a secondary plat at Merriman and Bethel Road. Ryan <br />Winley of Banning Engineering stated that this plat referenced the secondary plat of the Nice -Pak project. ARCO <br />Design and Build is the contractor for the project. This will be a 2 -lot secondary plat — Phase i is on the west side <br />of the creek, and Phase 2 will be warehouse construction on the east side of the creek. Map shows the draining <br />and grading plan. Retention basin will be located on the south west side of the plat, south of Phase 1. Mike <br />Young verified all utilities. Jeff Deiterlen stated that at the Tech Meeting it was stated that most traffic will be <br />routed through truck entrance, not the entrance on Bethel Road. Joshua ? stated that just south of Merriman is <br />Equipment Technologies training center, and traffic and access will not affect his property. Mike Young called <br />for a motion; Mark Taylor motioned to approve, and Kimberly Schofield seconded. Motion passed unanimously. <br />2 <br />
