Mooresville Planning Commission, January 8, 2021 <br />Mike Young introduced a rezoning request at 10377 North Bethel Road. John Heshelman representing the Phyllis <br />C. Smith Irrevocable Living Trust (the Trust) addressed the Planning Commission requesting a rezoning of the <br />property from agricultural to I2. Perry King clarified that the property was annexed into the city limits in 2005, <br />and that no building inspector had inspected the property and that currently there were no plans for future use <br />outlined. John Heshelman stated that there are currently no plans for the property. Perry King additionally <br />clarified access to the property for truck traffic would be off Hansel Parkway, and that car traffic would access the <br />property through Bethel Road. He also clarified that the request was based on the fact that I2 would be easier to <br />market and sell. John Heshelman replied that if the property were sold, and that the buyer requested a rezoning to <br />residential, the process would be followed at the appropriate time. Perry King stated that the Planning <br />Commission would need more information before approving the rezoning. John Heshelman stated that he would <br />probably ask for a continuance, as the Trust was able to get notices to the adjacent property owners, but did not <br />get a notice into the newspaper. Mike Dellinger, Executive Director of the Mooresville Economic Development <br />Corporation, addressed the Planning Commission, addressed the Planning Commission stating that the request of <br />the Trust came before the Planning Commission on request from the RDC. The Mooresville Comprehensive Plan <br />shows this property to be zoned industrial intent. RDC will use this property to grow the tax base, but currently <br />no specific project is in the works. The advice and request to the Trust by the RDC was to rezone now for future <br />development potential off Hansel Circle. Perry King stated that although it wasn't published in the paper, John <br />Heshelman had presented to the Tech Committee and this committee suggested he come forward. Mike Young <br />then called for comments and questions from the public. Cheryl Levin of 10335 Bethel Church Road addressed <br />the Planning Commission stating that she owned the 100 acres bordering this property, and did not receive notice <br />until January 14, although the notice was mailed on December 30. She stated that lots of semi -truck traffic moves <br />down Bethel Church Road and a new culvert put in at Linley was recently smashed by a semi. Joshua Hedrin of <br />10108 Bethel Road stated that he lives across the street from the property in question. He left Mooresville for <br />college and graduate school, but returned to Mooresville to build a house, raise a family and farm his family's <br />land. Rezoning of the property will put his livelihood at risk; if rezoned, he may have to sell a farm that has been <br />in his family for 175 years. He stated that "this community has always been a family", and there is no reason to <br />destroy farming families and their livelihood just to expand the Mooresville tax base. <br />Mark Taylor asked if access to the property were solely off Hansel Parkway would that be better for surrounding <br />properties. Joshua Hedrin stated emphatically, no, if would not be better. He stated that tax revenue and jobs <br />shouldn't be put ahead of a community of farmers. He stated, "Make the rezone change and you change everyone <br />in that community's lives forever." Gary Finchum of 10663 North Bethel Road addressed the Planning <br />Commission stating that he owns a house next to the property in question, and also owns a business in <br />Mooresville. He believes that an I2 rezone would impact his property values. He stated he worked for IPL for <br />30 -plus years and that from his professional experience, a flood plain assessment and wetlands determination <br />needs to be done. He stated that nothing had been done by the Trust environmentally. He believes that "we need <br />a lot more information before we move forward with a rezone." Dan Russell of 2317 Crosby Road reiterated that <br />he did not receive his notification in time. He referred to Attachment H of the notice which states that the rezone <br />will not have an impact on character and current structures. He spoke to realtors and did research on the internet <br />and believes the rezone to 12 would have a minimum negative impact of 11% on his property values. He moved <br />to Mooresville in 2015 as he liked the buffer zone outside town. He stated that traffic on 69 is not good, very <br />noisy. A property down the road is zoned agricultural but advertised as a butcher shop. There is a great deal of <br />traffic especially during deer season. Another of his neighbors is running a manufacturing business for race cars <br />out of his pole barn and FedEx trucks run up and down his private easement.
