163 <br />Rezone E North County Line Rd & Ferguson Rd - Ross Holloway of Holloway Engineering <br />requested a rezone of 27.43 acres from 1-1 to R1D. The adjacent property owners oppose the <br />rezoning and expressed concerns about stormwater runoff, retention ponds, and increased <br />traffic. Councilman Warthen and Ross Hollway discussed a narrow strip of land and agreed to <br />include the land in the rezoning. <br />Councilman Stanley made the motion not to uphold the unfavorable recommendation from the <br />Plan Commission and grant the R 1-1) zoning with Councilman Cook seconding. Motion carried <br />3-1-1. Councilman Swinney abstained, and Councilman Warthen opposed it. <br />Councilman Stanley made the motion to approve Ordinance 11-2021. Councilman Cook <br />seconded. Motion carried 4-0-1, Councilman Swinney abstained. <br />Rezone Old State Rd 67 & Sycamore Ln - David Gillman presented himself before the Council to <br />request a rezone of 0.1096 acres from industrial back to agriculture to build a detached garage <br />on his property, and not infringe on the portion of his land that is zoned for industrial use. <br />Councilman Williams made the motion to accept the Plan Commission's favorable <br />recommendation to rezone 0.1096 acres. Councilman Swinney seconded. Motion carried 5-0 <br />2nd Reading American Rescue Plan Ordinance - This ordinance establishes the fund to deposit <br />the funds that are anticipated from the American Rescue Plan. Councilman Stanley made a <br />motion to approve Ordinance 6-2021. Councilman Swinney seconded. Motion passed 5-0 <br />2nd Reading Police Reserve Program Ordinance - Chief Julian came before the Council to <br />explain the purpose of this ordinance that cleans up the previous ordinance and allows the <br />police commission to make any changes that need to be made. Councilman Cook made the <br />motion to approve Ordinance 7-2021. Councilman Williams seconded. Motion carried 5-0 <br />2nd Reading Park Dept Rules & Regulation Ordinance- Mr. Callahan came before the Council to <br />explain that this updates the current rules and makes the current rules enforceable. <br />Councilman Cook made the motion to approve ordinance 8-2021. Councilman Stanley <br />seconded. Motion carried 5-0 <br />New Business — <br />FloSource Inc CF -1 Personal Property —Council President Warthen stated that the expectations <br />for this CF -1 were exceeded. Mike Dillinger spoke on behalf of Flo -source and expressed the <br />family's gratitude to the Council for the support in keeping this business in Morgan County. <br />Councilman Stanley made the motion to find FloSource in substantial compliance. Councilman <br />Swinney seconded. Motion Carried 5-0 <br />Mac Owan Real Estate CF -1 Real Property - Council President Warthen stated the expectations <br />for this CF -1 were exceeded. Councilman Stanley made the motion to find Mac Owen Real <br />Estate in substantial compliance. Councilman Swinney seconded. Motion Carried 5-0 <br />Department Head Reports - <br />Chief Dalton stated that Vincennes University did not have the funding in place to purchase the <br />engine. There were discussions about advertising the open bidding on the vehicles. Councilman <br />Williams made a motion to allow the disposal of the engine to go forward via a sealed bid <br />process. Councilman Cook seconded. Motion carried 5-0 <br />
