EXHIBIT 'B' <br />VOLUNTARY ZONING COMMITMENTS FOR REZONE OF LAND <br />DESCRIBED IN EXHIBIT `A' FROM PLANNED UNIT DEVELOPMENT <br />RESIDENTIAL (PUD -R) TO SINGLE FAMILY RESIDENTIAL (R1C) <br />Per IC 36-7-4-1015 the petitioners herby make the following voluntary commitments <br />for the zoning of the land described in Exhibit `A' to the Town of Mooresville Plan <br />Commission. Said commitments shall run with the land and be binding upon their <br />heirs, successors and assigns until changed by subsequent petition for zoning <br />change to the Town of Mooresville Plan Commission and approval of same by the <br />Mooresville Town Council or by the operation of law. <br />COMMITMENT NO. 1 <br />Facade of each dwelling shall be constructed in substantial compliance with the <br />photographs of the facade of homes shown in attached Exhibits 1 and 2. These <br />exhibits are to be used as a guide for acceptable front elevation designs, however the <br />intent is to have a wide variety of styles with no dwelling with the same or nearly the <br />same exterior facade within two lots on the same side of the street. If vinyl siding and <br />soffit are used it shall be "Premium" gage vinyl having a minimum thickness of 0.046" <br />with embossed wood grain texture and/or wood shake appearance and shall carry, at a <br />minimum, a thirty (30) year transferable warranty. <br />COMMITMENT NO. 2 <br />Development standards for dwellings and lots shall meet the following minimum <br />requirements: <br />a) Roof pitch shall be 6/12 or steeper. Singles must be architectural type <br />either asphalt or fiberglass. Metal roofs are prohibited. <br />b) Eave overhang shall be not less than 12 -inches, as measured from the <br />finished face of the exterior wall. All eaves shall have aluminum gutters. <br />c) Minimum dwelling living area, exclusive of garages, porches, and <br />basements is 1,500 square feet. For dwelling of more than one-story <br />the ground floor area shall be not less than 1,200 square feet. <br />d) Each dwelling shall have a two -car attached garage with interior <br />dimensions of not less than 20 by 24 feet. <br />
