October 5, 2021 <br />The Mooresville Town Council met in regular session on Tuesday, October 5th at 6:30 P. M. at the <br />Mooresville Government Center. <br />Council members present were Council President Tom Warthen, Councilman Dustin Stanley, Councilman <br />Shane Williams, Councilman Jeff Cook, and Councilman Greg Swinney. Town attorney Cho-il Lee was <br />present. <br />Council President Warthen gave the prayer. <br />A motion was made by Councilman Swinney to approve the minutes of the September 21st meeting and <br />seconded by Councilman Stanley. Motion Carried 5-0 <br />Unfinished Business — <br />Budget Adoption - Councilman Swinney made the motion to adopt the 2022 budget. Councilman Stanley <br />seconded. Motion Carried 4-1 Councilman Williams opposed. <br />Phase III Village of Eastmore - Dave Moore gave an update on Phase III of the Village of Eastmore; it is <br />completed to the Town's specification and ready to be dedicated to the Town. Councilman Warthen <br />reiterated that the -street dedication will exclude alleys and street lights. Councilman Stanley made <br />the motion to have the legal counsel move forward with the dedication. Councilman Cook seconded. <br />Motion carried 5-0 <br />Councilman Williams gave an update on the 200th Anniversary. The website is under construction but is <br />active to sign up as a volunteer and or make a donation. Once the site is finished all event information <br />will be found at www.mooresvile200.com, <br />New Business— <br />Farmhouse Market Movie in the Park. Kim Burgess from FarmHouse Market came before the council to <br />discuss several events, including a Movie in the Park on November 26th; they would like to capitalize on <br />Shop Small Saturday and assist with Christmas Tree lighting. They have come before the council to make <br />sure the council was on board with the ideas. Councilman Warthen liked the idea but expressed <br />concerns about the preliminary lighting plan. Councilman Williams will pass along the name of the <br />people who donated the tree to see if they are still interested in presenting the tree as they expressed <br />they would be last year. Town Attorney Lee clarified that the Town would be hanging all of the lights <br />and garland. <br />Electronic meeting Resolution 25-2021 -This resolution will codify any use of electronics used for the <br />purpose of conducting town council meetings. Councilman Cook asked for clarification if the video <br />was a requirement or audio and video. The only requirement is that simultaneous communication must <br />be available, whether that be through audio and video orjust audio. Councilman Williams raised an <br />issue with one section that called for the participant to be seen and heard; Town attorney Lee stated <br />that could be amended to just heard. Councilman Williams made a motion to table the issue until the <br />next meeting allowing time for a final draft. Seconded by Councilman Stanley. Motion Carried 5-0 <br />CARES Act Transfer of Funds- Clerk -Treasurer Dianna Wamsley stated Indiana Finance Authority came <br />out with a directive that if we had sufficient public safety payroll amounts from March to September to , <br />equal the amount allocated to the Town they would accept that as a single expense on the application <br />and it would be one step for us as them. That did not mean the money has to be used for that; it was <br />just a means to simplify the process for everyone. However, since that's the approach we took, the <br />money has to go back to the general fund until we decide how to use it. And it has to be appropriated. <br />Councilman Stanley made a motion to adopt Resolution 26-2021, transferring COVID $314,834.00 <br />reimbursements. Councilman Swinney seconded. Motion Carried 5-0. <br />Councilmembers' after-hours access to the Clerk Treasurer's office - Councilman Williams asked for <br />clarification if all council members had access to keys to the Clerk Treasurer's office. Clerk -Treasurer <br />Dianna Wamsley read a statement for public record (see attachment Exhibit A) in response to <br />allegations that certain members of the council were receiving special treatment with regards to access <br />to the Clerk Treasurer's office. Clerk -Treasurer Wamsley made it clear that all requests for keys for the <br />council members would be addressed on an individual basis based on situations that would warrant the <br />
