He stated that if the Town was going to pay to replace it that he would want <br />some kind of signed agreement between the Town and Casey's and so far, his attempts to speak to their <br />Legal Counsel have been unsuccessful. There was discussion about possibly removing it instead of <br />replacing it since it is in the Town's right of way. Councilman Cook asked if that would make us liable if <br />someone hit their sign. Attorney Lee stated he would like to have more time to research to see if the <br />Town required them to put it there. <br />Councilman Williams amended his motion to allow Attorney Lee and Dave Moore 90 days to search for <br />documentation, before removing or replacing the guardrail. Motion was second by Councilman Stanley <br />and carried 4-1, with President Warthen opposing. President Warthen stated he believes the Town did <br />not require them to put it there and won't approve spending public funds to protect private property <br />unless he finds out otherwise. <br />Morgan County Animal Control —Officer, George Domazet stated that they have been investigating <br />Furry Friends Stay and Play, located at 390 N Monroe Street over the past nine months. They currently <br />have over 43 logged statements from citizens of Mooresville and Morgan County, as well as employees, <br />regarding issues with the.business. Reports include neglect, cruelty, injuries to dogs, cleanliness issues, <br />labor law violations, etc. The owner has been issued three citations for harboring non -immunized dogs, <br />which is a violation of state law. WTHR did a report on the business and interviewed the owner. Officer <br />Domazet stated the owner is also running a rescue and mixing rescue dogs with customers' dogs. <br />Animal Control has been working with officer McDaniel of the Mooresville Police Department regarding <br />these allegations but at this time no criminal charges have been filed. Officer Domazet is seeking the <br />Council's help in getting the business shut down. <br />Attorney Lee stated that if there is an ongoing investigation, he did not want to have a discussion on it, <br />however, he will look at the variance and ordinances to see if there are any violations. He stated that it <br />is difficult for the Council to have jurisdiction unless there is a violation of town ordinances. President <br />Warthen questioned if the variance can be pulled if it is deemed injurious to public health, safety, <br />welfare and morals. Councilman Cook suggested talking to the Town's former animal control officer, <br />Mark Taylor, to see if he knows of any ordinances that are being violated. Councilman Stanley asked <br />Legal Counsel to make this a priority. Councilman Swinney questioned if there was an inspection process <br />to see if the proper drainage was installed <br />Public Meeting Policy— Councilman Stanley stated that there is a policy on the books that is over ten <br />years old and does limit public comments to two minutes. He is asking the Council to look at the policy <br />and come back with recommendations at the next meeting to amend or strike the policy. He stated he <br />does not like the comments being limited to two minutes. <br />Crossroads Highway Products —Jeff Allen of Mooresville Welding and his wife, Stephanie Duncan, have <br />submitted an application to close Bolton Ave, from Washington to Taylor on Wednesday, April 20' from <br />approximately 6:OOam-4:OOpm. They have obtained all necessary signatures on the permit application. <br />The closure is to provide training for up to 100 DOT and INDOT personnel to teach them how to properly <br />install expansion joints. Mooresville Welding builds bridge expansion joints and Stephanie sells <br />materials. There has been an effort by the supplier of the materials to educate the workers on <br />installation. They have spoken to the one affected tenant and he does not have a problem with it. They <br />own the businesses on both sides of the street. Councilman Williams thanked them for keeping that <br />area looking nice. Mr. Allen stated they could provide a trailer to use as a barricade, if need be, and <br />Street Superintendent, Dave Moore stated the Street Department could provide barricades. President <br />Warthen stated that the Town appreciates the history of Mooresville Welding and the job that they do. <br />A motion to approve the street closing permit was made by Councilman Stanley, second by Councilman <br />Swinney and carried 5-0. <br />Parks Department— Kris Wilson, Parks Superintendent, stated that the covered bridge had a failed roof <br />and she wanted to thank the Street Department for taking that down so there would be access to the <br />soccer field and walking path. The Park Board will determine at a later date if they will replace it. The <br />park's lift station went out during spring break and even though the park maintains that lift station, the <br />Wastewater Department took care of it until a new one can be installed. It is on order. The park office <br />is currently closed and under renovation due to a mold issue. They are temporarily using some of the <br />Fire Department's office space. Kris wanted to publicly thank all the other departments for helping out <br />and let the Council know how well everyone has worked together. <br />
