December 20, 2022 <br />The Mooresville Town Council met in regular session on Tuesday, December 20, 2022 at 6:30 P. M. at <br />the Mooresville Government Center. <br />Council members present were Council President Tom Warthen, Councilman Dustin Stanley, Councilman <br />Shane Williams, and Councilman Greg Swinney. Town attorney Chou-il Lee was also present. Councilman <br />Jeff Cook was not present. <br />Council President Warthen gave the invocation and called the meeting to order. <br />Motion was made by Councilman Swinney to approve the minutes with two corrections of thaw <br />December, 2022 meeting and seconded by Councilman Williams. Motion carried 3 -0 -with Councilman <br />Stanley abstaining. <br />Unfinished Business — There were none. <br />New Business— Public Hearing for Additional Appropriation Ordinance 11-2022. This ordinance would <br />transfer $1,227,960 from the surplus general fund into the rainy -day fund. There were no public <br />comments. <br />A motion to close the public hearing was made by Councilman Stanley, and second by Councilman <br />Swinney. Motion carried 4-0. <br />Councilman Stanley motioned to approve Ordinance 11-2022, seconded by Councilman Swinney. <br />Motion carried 4-0. <br />Ordinance 12-2022 Indiana Code requires the Town to redistrict its election districts from the 2020 <br />Census by December 31, 2022. Redistricting of the Districts is not required because the districts, as <br />currently drawn, continue to satisfy all requirements of the Indiana Code. <br />Councilman Williams motioned to suspend the rules and vote on Ordinance 12-2022 on the first reading. <br />Councilman Swinney seconded. Motion Carried 4-0. <br />Councilman Williams made the motion to approve Ordinance 12-2022. Councilman Stanley <br />seconded. Motion carried 4-0. <br />Unified Development Ordinance (UDO) —Tammy VanHook from the Planning Commission presented the <br />updated UDO to the Town Council members. She discussed the process of public input, drafting, and <br />approving the UDO. There was some discussion about ensuring the residents in the buffer zone are <br />going to the appropriate entity for the time being and the importance of knowing the UDO that <br />will be in practice for January 1 to ensure all permits are filed and granted appropriately. The public <br />hearing was held at the Planning Commission meeting. Councilman Williams made a motion to accept <br />the UDO as recommended by the Planning Commission as written, second by Councilman Swinney. <br />Motion carried 4-0. <br />A letter from Dianne Huerkamp Director of Mooresville Public Library was presented with the names of <br />three individuals who expressed interest in serving on the board. Councilman Williams stated he would <br />like to see the positions of all of the open board positions posted and receive applications per the town <br />Policy. There was a consensus among the council that this would be the prudent course of action. <br />Nepotism Certification for Elected Officials. This is an annual required State Board of Accounts form that <br />each council member will need to sign and return to the Clerk Treasurer's office. <br />
