Barry wanted to know if there was any way of working with the neighbors if they could
help solve their water problems. Mr. Holloway said he didn't see how that would be
possible; you would probably have to get the Town involved, because the whole area
back there is low and some of the yards and the houses have been built to low. They can
definitely take care of their problem and take care any runoff they may have. Possibly
with the construction of a gravel bed it would improve the situation in some of the back
yards there. But it will not help in a huge rain; you are still going to have water issues.
They will not create or worsen the problem; they will make provision to take care of their
run off.

After hearing the requirements from developmental standards and the discussions, Mr.
Kramer asked for a motion for or against the petition. Mr. Crouch asked Mr. Holloway if
the drainpipe went down the alley where the water drains to the south and under South
Slxeet and Mr. Hollowy said that was correct. Mr. Crouch ask if there were any
easements out in front, so a dry well or retention area that could be piped down to the
front and hooked into the exisfng drain. Mr. Holloway said they could provide
easements to do that. Mr. Crouch said they would have to go across Mr. Curry's
property. Mr. Holloway said they would agree to have a ten-foot drainage easement on
the west side of the property. Mr. Crouch showed Mr. Curry what he was proposing.
Mr. Crouch said he didn't see where the water would go in a heavy rain and Mr.
Holloway said that is why they are proposing to put in a gravel bed to hold the water until
the water could be dispersed.

Motion was made by Mr. Crouch, second by Mr. Swisher, to approve the division of the
two lots with the following stipulations. One that a retention system must be constructed
that collects drainage added and retained'on their lot, all additionai run off from the
construction on this lot. Two subject to granting of drainage easement ten-foot wide on
west side of property to allow for pipe that could reduce water if possible to South Street
when available. Three subject to minor platting of this property into two lots as shown in
drawing. Motion carried as 3-1.

There being no new business, a motion to adjoum was made by Mr. Barry and second by
Mr. Crouch. Motion carried 4-0.

The next meeting of the Mooresville Board of Zoning Appeals will be Thursday,
February 13, 2003 at 6:00 P.M. at the Mooresville Town Hall.
