MOORESVILLE BOARD OF ZONING APPEALS MINUTES THURSDAY, MARCH 11, 2004 The Mooresville Board of Zoning Appeals met on Thursday, March 11, 2004 at 6:00 P.M. at the Mooresville Town Hall. Board members present: Chairman, Alan Kramer, Don Barry and Jon Swisher. Member absent: Mike Young and Christopher Crouch. Tim Currens, Town Attorney, was present. Motion to approve minutes of the February 12, 2004 meeting was made by Don Barry, second by Jon Swisher. Motion carried 3-0. First on the agenda was Ross Holloway, Holloway Engineering, representing the New Life Community Wesleyan Church, State Road 144, requesting a variance of use asked for a continuance until April 8, 2004. Motion was made by Jon Swisher, second by Don Barry, to continue the variance of use for New Life Community Wesleyan until April 8, 2004. Motion carried 3-0. Next was Karen Harman, 440 Maple Lane, requesting a variance of use to operate a Therapeutic Massage Practice, which was continued from January 8, 2004. This was tabled until the Town Council approved the new Comprehensive Plan. Since this plan had not been adopted as of yet, the board said they would go ahead and make a decision of the variance. Mr. Barry stated that he had driven up that way to look at the area and he felt that this business would make a very low impact on the area. After reading the Facts of Finding for Variance of Use, Mr. Kramer asked for a motion to approve or deny the variance. Motion was made by Don Barry, second by Jon Swisher, to approve the Variance of Use for Karen Harman, 440 Maple Lane, to operate a Therapeutic Massage Practice with the restrictions that all minimum and maximum requirements for a sign be met and there will be no lighting. Motion carried 3-0. Mrs. Harman asked where she could get the requirements for a sign and she was told to see Mr. Beikman our Building Inspector. Next was Millard L. David, 10022 Old State Road 67, requesting a variance of use to operated a used car business. Mr. David said there has been a used car business there since 1950. They had let their license expire and now they would like to reinstate the license. Mr. Swisher asked how the property was now being used and Mr. David said he was now storing Corvettes in the building. Mr. Kramer asked if he had inside and outside storage and Mr. David said he had 3,000 feet of inside storage. Mr. Kramer stated ail his storage was inside with some cars outside on lot to be sold and Mr. David said that was right. Mr. Currens asked if there would be a limit of numbers of cars they would have and Mr. David said would have about twenty to twenty-five CarS.
