<br />MOORESVILLE BOARD OF ZONING APPEALS <br />MINUTES <br />THURSDAY, JULY 8, 2004 <br /> <br />The Mooresville Board of Zoning Appeals met on Thursday, July 8, 2004 at 7:00 P.M. at the <br />Mooresville Town Hall. <br /> <br />Board members present were: Alan Kramer, Chairman, Mike Young, Don Barry, Christopher <br />Crouch and Jon Swisher. Town Attorney, Tim Currens, was present. <br /> <br />Motion to approve the minutes of the June 10, 2004 meeting as corrected was made by Jon <br />Swisher and second by Don Barry. Motion carried 5-0. <br /> <br />First on the agenda was a letter from Holloway Engineering requesting the continuance for the <br />variance for Rick Remster and Ed Bartley for an advertising structure at State Road 67 and State <br />Road 144 until August 12,2004, so they can speak with the Mooresville Park Board. Motion to <br />approve the continuance of the Rick Remster and Ed Bartley variance until August 12, 2004, was <br />made by Don Barry, second by Chris Crouch. Motion carried 4-1 with Jon Swisher opposing. <br /> <br />Next was Marvin Cable, T&W Corporation, representing Family Video Movie Club, requesting <br />a variance for setback of footage and signage at 5 East Harrison Street. They will be building a <br />retail facility for movie rental at the corner of Indiana Street and Harrison Street. The property is <br />currently zoned B-2 local business, that zoning allows for a 5,000 square foot building and they <br />are planning on building a 6,150 square foot building, so they are asking for a variance of <br />footage to allow for that size of building. The ordinance allows for the way they would like to <br />do the signage and there is a question on setback on two sides of the parcel. Mr. Barry asked if <br />they would be tearing down to build the new structure and Mr. Cable stated they would be <br />removing the house and garage. Mr. Cable stated that the new structure would set on the <br />southeast corner of the lot so it would open up the lot for parking and not block sight for traffic <br />flow. Mr. Cable said that Family Video purchased three parcels, they would be using two <br />parcels and the third parcel has a house, which will remain residential. The parking for the new <br />structure will be in the front mostly along Indiana and Harrison Streets. Mr. Barry asked what <br />the signage will be and Mr. Cable stated it would be a pole sign about 100 square feet and they <br />are asking to be able to set the sign on the corner of Harrison and Indiana St within fifteen feet <br />from the public right-of-way. Mr. Cable stated that they are not proposing any curb cuts off of <br />Indiana Street. <br /> <br />Mr. Rick Wagner,S E Harrison St, said as owner of the property and pizza business he was <br />asking for support from the board on this project. He said the pizza shop was moving to the <br />shopping center. Mr. Young asked what the business hours would be and the District Manger <br />of Family Video said they would be open from 10:00 AM to Midnight 365 days a year. <br /> <br />Mr. Kramer asked if they have a flexible plan for moving the signs around and Mr. Cable said <br />the sign would be twelve feet above the ground so it would not be restrictive visually, there <br />would be shrubs and decorative rocks at ground level.
