the sign being up, but he is afraid that the sign at the far end of the parking lot would not be
attractive. Mr. Barry asked why couldn't they put the sign on the Broad alley corner. Mr. Cable
said moving the sign to the other corner was more favorable. Mr. Young asked why they would
be removing the trees and Mr. Cable said there were a couple of reasons. One the trees are quite
huge and in a storm they would be damaged anyway. Two they are uprooting the sidewalk and
they would be replacing the sidewalk making it look better. They want to replace them with
their own landscape for reasons of visibility, will make the site look freshly developed and
brought up to standard, and will help stop a lot of debris from falling onto the highway causing
traffic hazards. Mr. Barry asked if they have any objections to moving the sign to the south west
corner of the lot and Mr. Cable stated he would need to talk to his client, he did not feel there
was a problem moving it to the mid point of the property, but he was not sure about the south
west corner. Mr. Cable said for the record that in some areas Family Video carry a selected
area for some videos and they have determined that for this location there will not be a selected
video area.

After reading the fact-of-finding for the variance of developmental standards Mr. Kramer asked
for a motion to approve or deny a variance for setbacks. Motion to approve a variance for
setbacks from twenty feet to eleven-half feet along the alley way was made by Don Barry,
second by Christopher Crouch. Motion carried 5-0.

Mr. Kramer asked for a motion for the square footage of the building. Motion to approve the
variance for square footage of the building from 5,000 to 6,160 square feet was made by
Christopher Crouch, second by Don Barry. Motion carried 5-0.

Mr. Kramer asked for a motion for the variance of signage. Motion to approve the variance for
signage larger than 100 sq. ft maximum allowable; one sign is 100 sq. ft. plus the sign on the
face of the building, which will be centered on the building, and the one sign will be located on
the tenth parking space from the north was made by Don Barry, second by Christopher Crouch.
Motion carried 4-1, with Alan Kramer opposing.

Motion to restrict the petitioner from having adult programming was made by Don Barry, second
by Mike Young. Motion carried 5-0.

There being no further business a motion to adjourn was made by Don Barry, second by Mike
Young. Motion carried 5-0.

The next meeting of the Mooresville Board of Zoning Appeals will be August 12, 2004 at 7:00
PM at the Mooresville Town Hall.

¿Zed-.-, / ~
Chairman
