<br />MOORESVILLE BOARD OF ZONING APPEALS <br />MINUTES <br />THURSDAY, AUGUST 12, 2004 <br /> <br />The Mooresville Board of Zoning Appeals met on Thursday, August 12, 2004 at 7:00 P.M. at the <br />Mooresville Town Hall. <br /> <br />Board members present were: Chairman, Alan Kramer, Christopher Crouch, Mike Young, Don <br />Barry, and Jon Swisher. Town Attorney, Tim Currens, was also present. <br /> <br />A motion to approve the minutes of the July 8, 2004 meeting was made by Don Barry, second by <br />Christopher Crouch. Motion carried 5-0. <br /> <br />First on the agenda was Ross Holloway, Holloway Engineering, representing Mr. Ed Bartley <br />with a petition that was continued from the July 8, 2004 meeting. Mr. Holloway sent a letter <br />requesting a denial of the petition, because according to our Ordinance they need a waiver from <br />the Park Board to construct the advertising structure. The Park Board on July 12th denied the <br />petition for a waiver unanimously. <br /> <br />Motion was made by Don Barry, second by Mike Young, to deny the petition by Mr. Ed Bartley <br />for a variance to construct the advertising structure on the northwest corner of the intersection of <br />State Road 144 and State Road 67. Motion carried 5-0. <br /> <br />Next was Ralph Foley, representing Cedar Run Limited, with a petition for a Special Exception <br />for a Church to be constructed in an area zoned B-2. Mr. Currens stated the Plan Commission <br />has already reviewed the Special Exception and have found that it does not adversely affect the <br />master land use plan and it is now ready to be heard this evening. Mr. Foley said that this parcel <br />is zoned B-2 for local business and our ordinance provided for a special exception for a church in <br />a B-2 district. This parcel is located at the corner of Heartland Boulevard and County Line <br />Road. Heritage Christian Church is seeking to expand their ministry and developed a new <br />church site where they can have enough parking and space for their building. There apparently <br />has been no interest in the site for local business and they have been unable to market it for retail <br />business. This would be a more compatible use for the neighborhood, fulfill the needs of the <br />church and the church would be able to expand their church building and be a good neighbor. <br />They stated that there was a mound around the parcel and they would not be taking the mounds <br />down. Mr. Jay Link of the Heritage Christian Church stated that their present building would <br />only hold around one hundred people comfortably, the building is not in real good shape and the <br />only parking is on the street. The new location would hold around six hundred people and they <br />would have ample parking space for them. They are excited about possibly being able to move <br />into the community of 2500 homes and being able to try and have a positive impact on the <br />community. Mr. Barry asked what their plans were for the existing church and Mr. Link stated <br />they were planning on selling to a smaller church. Mr. Swisher asked if there was an entrance <br />from Heartland Blvd. or was the only entrance from County Line Road? Mr. Foley said there <br />was an existing driveway that lines up with Ayrshire Circle. They are proposing a driveway <br />onto Heartland Blvd. and onto County Line Road. <br />
