<br />Mr. Gary Gresham, 6331 E Chapel Hill Ct., asked if the church would be held to the same kind <br />of requirements as the homeowners were originally held to, as masonry structure, so they would <br />have some kind of protection for their property value. He was also concerned with the lighting <br />on the parking lot and the landscaping. Mr. Foley said the lighting would be the new lighting <br />that would be directional and fully shielded. The developer has already said that the structure <br />would have to be compatible with the community. <br /> <br />Several homeowners expressed their concerns that the church would be under the same <br />covenants as to how the structure will be built and the type of material used. The developer and <br />the church said they would be willing to meet with the homeowners to discuss their concerns. <br /> <br />After reading the Fact-of-Findings for the Special Exception, Mr. Kramer asked for a motion to <br />approve or deny the petition. Motion was made by Christopher Crouch, second by Don Barry <br />to approve the Special Exception for Cedar Run Limited for a church in an area zoned B-2. <br />Motion carried 5-0. <br /> <br />Next was Ross Holloway, Holloway Engineering, representing William Parks, requesting a <br />variance from development standards of setbacks for the Wendy's sign. The existing sign is ten <br />feet from State Road 67 and they want to relocate the sign over to the east on Lot 1, which is <br />where Wendy's is located, or on Lot 2. There is a power line that runs not quite parallel to State <br />Road 144, so they are asking for a variance of setback from twenty feet to ten feet. This will <br />allow them to locate the sign on a narrow strip between the right-of-way and the power line. <br />The existing sign will be removed and they are not sure if the new location will be on Lot 1 or <br />Lot 2. Mr. Kramer asked if the sign would be perpendicular to State Road 67 and they said it <br />would be at an angle so it could be seen from both highways. Mr. Kramer asked if any of the <br />over hang would be over the easement for the power line and Mr. Holloway said it would not. <br /> <br />After reading the Fact-of-Finding for variance of development standards Mr. Kramer asked for a <br />motion to approve or deny the petition. Motion was made by Mr. Jon Swisher, second by <br />Christopher Crouch to approve the variance from development standard for the setback from 20 <br />feet to 10 feet for a sign to be located either on Lot I or Lot 2 Parks Minor Plat. Motion carried <br />5-0. <br /> <br />There being no further business to come before the board a motion to adjourn was made by Mr. <br />Barry, second by Mr. Jon Swisher. Motion carried 5-0. <br /> <br />The next meeting of the Board of Zoning Appeals will be September 9,2004 at 7:00 P.M. at thetMooresville Town Hall. <br /> <br />CCi?
