President Beebe said the commission could <br />instruct the building inspector to make periodic checks to see if the pool is covered if it is not in <br />use. <br /> <br />Ross Holloway presented a four lot minor plat request for Future Dream Estates, James and <br />Nancy Gray, located near intersection of Bunker Hill Road and St. Rd. 42 next to two story <br />building with stone fence surrounding. Parcel 1-21.76 acres, Parcel 2-36.67 acres, Parcel 3- <br />24.219 acres. Mr. Holloway brought survey showing a recorded easement - Book 162, pages <br />438-440. Mr. Holloway had septic permits for lots one thru four. This is all coming out of <br />Parcel 2 which is 36.67 acres. This will be served by public water. Motion was made by <br />Commissioner McGuire, second by Commissioner Young to accept minor plat with addition of <br />shared maintenance agreement for access to Lot 1 & Lot 2, no direct access to St. Rd. 42, waive <br />depth to width ratio variance and include notes that upon building the third house, the state road <br />improvements need to be met. Motion carried 5-1. Commissioner Pygman opposed. <br /> <br />John Drapalik represented a request for Jim Kays Minor Plat at 1640 Orchard Road. The parcel <br />was bought in the 1970's and he purchased an additional 4.7 acres later. In 1972 the original <br />parcel was split off and Lot #2 is the residue. On Lot # 1 a 1400 square foot three bedroom brick <br />home is proposed. The parcel is serviced by city water. Soil samples were submitted for Lots 1 <br />and 2 even though building on lot 2 has not been considered. Access to Lot 1 is on Orchard <br />Road, so an additional driveway will be needed. Richard Stapert told the commission he lives <br />across the road and there is a 60' ingress egress on the Kay's property. He said he understood <br />Kays owned 30' and Pellam owned 30' and his question was who was responsible for this <br />easement. Town attorney Tim Currens told Mr. Stapert if easement is for access, both owners <br />have the right to improve, but Pollams do not have to have Kay's permission to cut trees. Anna <br />Stapert said that in March of 1971 the ingress egress easement was put in for Gerald Christner to <br />get to his land in the back. And at present the 60' strip was not developed. Mr. Currens told the <br />Staperts Mr. Kays and Mr. Pellam had exclusive rights to improve their easement and reiterated <br />the fact this was not a public easement. Bill Pellam, 1636 Orchard Road, asked if there were <br />two lots or one beside the Kay's house. Mr. Drapalik said Mr. Kay's house is on a separate tract <br />purchased in 1972. Proposed Lot 1 and Lot 2 is on a tract purchased in 1978. So there could be <br />a total of three houses, but there were no intentions of building on Lot 2. Mr. Kay's told the <br />commission he would have no objection to putting a note on plat stating no residence would be <br />built on Lot 2. Motion was made by Commissioner Young, second by Commissioner McGuire <br />to approve request for minor plat with stipulation that notation on plat for no further residence is <br />to be built on Lot 2. Motion carried 6-0. <br /> <br />President Joel Beebe reported a letter of complaint had been received from John Littlejohn <br />concerning a storage building in front of the building line of a home located at 688 Red Oak . <br />Building Inspector Joe Beikman has seen the barn in front of residence. The commission <br />instructed Tim Currens to send a letter. <br /> <br />Complaints concerning a semi-trailer advertising Lost Name were discussed. Tim Currens will <br />check the ordinance to see if this is allowable. <br />
