Mr Kays said 6 people <br />were living there. <br /> <br />Frank Hogan, attorney for surrounding neighbors, cited an NPDES permit issued 10-0 I -96 to C <br />& M, he said permit in no way limits local jurisdiction to make decisions concerning proposed <br />development. He cited Final order granted to C & M on 01-28-98, giving authority to render <br />sewage disposed in rural area. Attorney Hogan asks the brochure fÌ'om 4-22-99 meeting be <br />introduced into evidence, also, the plat drawing fÌ'om tonight and other meetings be introduced. <br />Jim Patrick held up drawing fÌ'om August, 1999 meeting indicating where buffering was located <br />behind Patricks and other properties. He said now on the Plat brought in tonight's meeting, there <br />was shown very little buffering for the Patricks and no buffering for the other properties. <br />Concerns about the road issue was brought up, saying more than two streets coalescing at a point <br />is against Ordinance. Question was asked about the first entrance to subdivision, if it had been <br />signed off on by the County. The commission was reminded that at a previous meeting, Brad <br />Yarger, engineer, had mentioned sight problems with the first entrance and that entrance is off a <br />road that is heavily traveled. <br /> <br />~ <br /> <br />John Mutz, 9250 Viola Way, told the Commission he understood the owner of C & M Utility <br />was also owner of Countryview Estates and he thought this owner wanted to put similar homes <br />in Countryview Estates. Building Inspector Joe Beikman told Mr. Mutz that lot size and house <br />size was the reason the Countryview plat was turned down at first. <br /> <br />Raymond Kays said that at the last meeting the talk was 350 gallon per home, now it was down <br />to 166 gallon per home and Hendrick's County uses 400 gallons per home, so now he is <br />confused. <br /> <br />Ross Holloway said that in May of 1996, Town ofMooresville was notified oflURC hearing for <br />C & M Utility and a statute says that a small utility could opt out ofrate procedures so, C & M <br />did this to save on lawyer and engineer fees. He said C & M still is charging $45.00 a month <br />and have no plans to raise rates. Mr. Holloway told the Commission he would stipulate 20 foot <br />buffering is included in the Plat. <br /> <br />Commissioner McGuire read page 1 of Subdivision Ordinance-owner must show provisions for <br />sanitary, water supply, drainage, etc. and based upon this, Commissioner McGuire made a <br />motion, seconded by Commissioner Marshall to deny plat approval due to sewage problems, <br />land use of road, topography, and other issues for findings of facts. Motion carried 7-0. <br />
