<br />Attorney Tim Currens said C & M was owned by Chris Crouch. Mr. O'Neal said C & M had <br />been given the authority to serve area from Indiana Regulatory Commission and currently C & <br />M had excess capacity for minimum of 80 homes. Mr. Holloway said this would take care of <br />Phase 1 and part of Phase 11. Commissioner McGuire asked if anyone knew who held <br />Certificate of Authority. Ross Holloway said worst case scenario would be if development had <br />to install their own wastewater treatment plant. Commissioner Pygman commented Ashbury <br />Park Treatment Plant was within one-half mile of this area and it was dumping on Ed Bucker's <br />property. He said the State was not overseeing this problem. <br /> <br />Commissioner McGuire stated over one quarter million gallons of treated water will be coming <br />down thru area. He said the responsibility of Plan Commission is to see that a good treatment <br />plant is there for preliminary plat approval. <br /> <br />There was a question of what is going to happen ifC & M can't get financing. Mr. Hogan said <br />he knew of a private system that could not get financing andCity of Indianapolis had to take over <br />and that this could happen between this development and Mooresville. Mr. Hogan said he did <br />not believe the second access was the answer, that there were other issues concerned such as <br />sewage and buffering was not wide enough. He also said the Patrick's bordering this <br />development would have public right of way around three sides of their property. <br /> <br />~ <br /> <br />Mr. O'Neal said he wanted May 22, 1999 minutes made part of this record. Commissioner <br />McGuire read statement from Commissioner Abbott's motion from the April 22, 1999 meeting. <br />Ed Moore, Mantooth Estates asked Commission if the person that gets treated water dumped on <br />has any say. Commissioner Beebe said one of responsibilities of Plan Commission is to protect <br />homeowners. Mr. Geiger of Rooker Road said local Government is responsible for where water <br />goes, IDEM is not interested. <br /> <br />Steve Leatherman said he spoke with C & M and was told the problem as of right now was there <br />were not enough users to run the plant efficiently. <br /> <br />Ron Lehr, David Wilson, Nellie Judd, Kevin Watkins, and Ray Stanley all spoke in opposition to <br />the development. Bob Turner, 1345 Dayhuff Road told the Commission he thinks plat shows <br />lack of courtesy to neighborhood. He said he had asked that some of the houses be taken out to <br />keep more wooded area and they did not do this. Jo Ellenberger of Mantooth Estates said water <br />bill will be three times higher. Raymond Kays thanked the Commission for considering the <br />amount of discharged water from treatment plant that will go across his property. Mr. Patrick, <br />1101 Dayhuff Road told the commission he did not see how he could live with roads on three <br />sides of his property. Connie Patrick told the Commission the Developers had not been a good <br />Community partner because they had not told residents what they plan. Attorney O'Neal said <br />the developers have complied with ordinances ofMooresville. Town Attorney Tim Currens <br />said the Plan Commission's job was to make sure regulations of Ordinance are met including <br />Section 3, Article I --he was not sure about jurisdiction of run-off and a decision must be based <br />on actual fact not mere speculation. If anyone feels they need to check out information, they <br />should. Motion was made by Commissioner McGuire, second by Commissioner Ehrhart to <br />postpone request until Commission establishes who has jurisdiction over run-off water, specify <br />
