Other residents in the area, Mr. Martinez, Walter and Thomas Irving, Martin Witte, <br />Charles Carter, and Dr. Diane Johnson all spoke opposed because of such reasons as: Traffic, <br />type of disorders these people would be suffering from such as addiction, and the idea that with a <br />PUD-IE, anything could be allowed to open in this area. <br /> <br />Mr. Holloway told the concerned residents that length of stay is a one year lease and less than <br />5% turnover, the type of person is single, early twenties to sixties iil age, no children, no alcohol <br />or drug abuse, may be schizophrenic, and live on low incomes, some are on SSI. The incidence <br />of danger to children and family is no higher than in the general population. The residents are <br />really reclusive--scared of the world. No one has two cars and some can't afford to drive. After <br />much discussion, motion was made by Commissioner Pygman, second by Commissioner <br />McGuire to recommend to the Town Council to deny petition for PUD-IE. The vote was two for <br />the motion, four opposed, and one abstention. Next, a motion was made by Commissioner <br />McGuire, second by Commissioner Kimmel to table to the January 2Ø, 1999 meeting. Motion <br />carried 7-0. <br /> <br />A letter of complaint about Lundy's Garage on Merriman Road was discussed. Commissioner <br />Kimmel said the garage had been there for years. Joe Beikman had talked to Cecil Lundy and he <br />said he began the business full-time in 1991. The Buffer was extended in 1994. That was the <br />use when the Buffer was extended. Town Attorney Tim Currens will look at the dates and report <br />back to the Commission. The use may be grandfathered in. <br /> <br />A discussion was held concerning plats that went thru the County as a PUD. Building Inspector <br />Joe Beikman said most restrictions do not meet our Ordinance, such as lot size, setbacks, and <br />square footage allowed. A motion was made by Commissioner Young but was not seconded to <br />take the part in our Buffer Zone under Mooresville's jurisdiction. Town Attorney Tim Currens <br />said they can't go beyond two miles. The concensus of the Commission was, if changes were <br />requested for these PUD's, the Plan Commission wants to hear them. <br /> <br />M & M Investment Co. purchased the Eagles Lodge property and will put in Assisted Living <br />units. The property is zoned B-3 at the present time. The company wants to make sure they are <br />doing things correctly. They wanted to file for a B-2 but the building size will be over 5,000 <br />square feet. Town Attorney Tim Currens recommended B-2 instead ofR-3. B-2 limits size of <br />structure and Ordinance doesn't designate R-3 as this type of structure. Commissioner McGuire <br />recommends B-2 and grant a variance for Building size. Attorney Currens doesnt't think <br />building size could be waived at Plan Commission. The Commission agreed with this <br />recommendation. <br /> <br />Ross Holloway requested an informal discussion for Condos on Highway 144. <br /> <br />/.Áoss Holloway reported R & J Associates third report for the Treatment Plant at the Trailer Park <br />will be on the agenda at the January meeting, 1999. Commissioner Pygman wants Dan Tingle, <br />'-' Superintendent of Mooresville's Waste Water Treatment Plant, to inspect R & J Assoc. <br />
