The Southeast corner closed to buyers and just open to Mooresville. <br /> <br />3. No 1-2 or 1-3 allowed. <br /> <br />Residents speaking opposed were: Mr. McCloskey 45 Woodside Dr., Richard Morley, 30 <br />Woodside Dr., Jack Woolard, 66 Woodside Dr., Mike Kirk, 73 Woodside Dr., and Jerry <br />Strawder, 43 Rosewood Dr.. Jack Woolard informed the Commission a natural underground <br />water lake was under this development and even the Town ofMooresville gets water from this <br />lake bed, some companies could put this water in danger. <br /> <br />Ross Holloway said the County had zoned this property B-3, which none of the residents had <br />known, even Commissioner Ehrhart whom had lived in the addition for II years said he was not <br />aware of the B-3 zoning. <br /> <br />Ross Holloway also said Rainbow Lane would not be used and could be put on the Plat and a <br />note on the Plat to notify all adjacent property owners per our Ordinance requirement before <br />each new Industry came to the POO. <br /> <br />'-- <br /> <br />Commissioner McGuire questioned the need to rezone more land for Industry at this time. After <br />much discussion a motion was made by Commissioner McGuire, second by Commissioner <br />Bennett to recommend to the Town Council to deny rezone from B-3 to POO-I. Motion carried <br />5-1, Commissioner Abbott opposed, and I abstention, Commissioner Young. This rezone will <br />come before the Town Council at the November 4, 1998 meeting. <br /> <br />Mr. Childers was on the agenda becaused his certifieds gave tonight's date, but should have been <br />for the BZA on Wednesday, October 21, 1998, because he is seeking a variance for his gift shop <br />at his home on Indianapolis Road. The Commission said if he decided to go to the November <br />BZA meeting, he would have to send new notices. Mr. Childers requested to stay open until the <br />November meeting. Consensus of the Commission was to remain closed until the BZA meeting. <br /> <br />Attorney Phil Smith was present at Town Attorney Tim Currens request. Attorney Currens is <br />recommending Mr. Smith to represent the Town in a lawsuit with Jim Remster due to a Conflict <br />ofInterest. Mr. Smith is willing to be Counsel for the Plan Commission and stated action is <br />pending at this time. A court order will come to produce minutes and tapes of the meetings. <br /> <br />The Commission was told to sign a document of Finding of Fact for the Remster property. The <br />fact, page 34 and 35, Setback requirements anticipating lot not being anywhere else but these 4 <br />places- House does not face any road, access lane stops at property line. Mr. Smith will bring <br />the document for President Joel Beebe to sign. <br /> <br />-- <br />
