<br />4B, and 4C. These lots lie to the north of Perkins Restaurant. Motion was made by <br />"-- Commissioner Pygman, second by Commissioner Campbell to approve the additional three lots <br />subject to full construction prints and Availability Fees being paid. Motion carried 6-0. <br /> <br />Next, Foley, Foley, and Peden representing Indiana Farmers Ventures at 204 East High Street <br />asked for a continuance to the August meeting. They were requested to send out new notices. <br /> <br />Remster Minor Plat-Indianapolis Rd.- Attorney Ksenak and Ross Holloway-Both stated this <br />plat had met all Ordinance requirements. Mike Monday ofNicePak had questions concerning <br />the sewer easement. Ross Holloway said an easement thru NicePak would be nice but not <br />necessary, a lift station for each lot could be used. Mr. Monday said NicePak may need to <br />increase parking lot size and that would interfere with an easement, a granting of an easement <br />would have to be under certain circumstances. Commissioner Ehrhart felt this Minor Plat not <br />cohesive with the surrounding area. Attorney Ksenak stated a Court would mandate this plat be <br />approved if the Plan Commission denied it. Finding of Fact: to find the Plat submitted met with <br />Ordinance requirements. Attorney Ksenak said if Finding of Fact has been met he asked the <br />Minor Plat be approved automatically. <br />Motion was made by Commissioner Campbell, second by Commissioner Kimmel that Minor <br />Plat does follow Ordinance requirements and the Plat be approved. Vote was 4-2, with <br />Commissioner Young and Pygman opposed. This motion fails because it needs a quorum of 5 <br />and the Commission has three absentees. This was a no motion to not approve, so the matter is <br />tabled to the August meeting. No new notices need sent. <br /> <br />'-- <br /> <br />Building Inspector Joe Beikman reported the business on High Street falls under customary <br />occupations, but the sign is not the correct size. He will send a notice. Also, the Board of <br />Zoning Appeals had given a variance at the old car wash for a car lot on Indianapolis Road. <br />Now, this is being used as a Flea Market. Property is zoned B-3 with a Special Exception. A <br />Flea Market has to be an 1-1 classification. Town attorney Tim Currens will send a letter of <br />notification. Fifty-eight (58) permits were issued and one hundred thirty (130) inspections were <br />completed. <br /> <br />There being no further business to come before the Commission at this time, a motion was made <br />by Commissioner Campbell, second by Commissioner Young to adjourn the meeting. Motion <br />carried 6-0. <br /> <br />The next scheduled meeting for the Mooresville Plan Commission is Thursday, August 27, 1998, <br />at 7:00 P.
