<br />Mr. Ross Holloway appeared before the Plan Commission on <br />behalf of Bill Parks petitioning for a rezone from B-2 to B-3 <br />for Lot 3 of the Park Minor Plat, said lot is located at the <br />northeast corner of State Road 67 and State Road 144, <br />containing 2.118 acres, more or less. <br /> <br />The purpose for requesting a rezone from B-2 to B-3 is <br />to enable a covenience store which dispenses gasoline, be <br />located at this location. Bill Abbott stated this is the <br />same parcel which B-3 zoning was denied at an earlier time <br />due to the intense traffic in this area. Mr. Abbott stated <br />the circumstances in this area have not changed. <br /> <br />Mr. Holloway informed the Commission that this petition <br />is to rezone only one lot of this minor plat, not the entire <br />minor plat, which would not cause more traffic in this area. <br /> <br />Bill Abbott stated that adding a gas station to this <br />extremely congested area would increase the congestion in <br />this area. <br /> <br />Charles McGuire stated that the Indiana Department of <br />Transportation has plans to improve this intersection in the <br />near future which will help the congestion in this area. <br /> <br />Motion was made by Charles McGuire, second by Tim <br />Bennett to approve the petition of Bill Parks to rezone Lot 3 <br />of the Parks Minor Plat from B-2 to B-3. Motion was <br />defeated 3-5. <br /> <br />A letter from Rick's Mooresville Muffler, Inc., 125 <br />South Indiana Street, Mooresville, Indiana was presented to <br />the Commission filing a complaint against the use of the <br />property at 7 E. Harrison Street, Hooresville, Indiana. <br />The letter stated the property is not zoned for selling <br />tires, tire repair, washing cars, exhaust, mechanic work and <br />oil changes, which is the current use of this property. <br /> <br />Mr. Robert Stewart, one of the owners of the property <br />located at 7 E. Harrison Street, Mooresville, Indiana, asked <br />the Commission what property needs to be zoned for this use. <br /> <br />Mr. Stewart was advised this property is currently zoned <br />B-2, and B-3 zoning would be necessary for the current use of <br />the property. <br /> <br />~ <br /> <br />The Commission will advise the owners of the property <br />located at 7 E. Harrison Street, Mooresville, Indiana that <br />they are in violation of the Town of Mooresville's zoning <br />ordinance and the owner will need to come into zoning <br />compliance. <br /> <br />3 <br />
