Mr. Holloway explained <br />that the lot owners will be assessed a fee at the time of the <br />property closing to fund the maintenance of retention areas <br />and there will be an annual fee for this purpose. <br /> <br />Mr. Phil Nicholson, 24 Carol Lane, Mooresville, Indiana <br />inquired of Mr. Barnes of the Morgan County Soil and Con- <br />servation DistrIct if Environmental Development Corporation <br />is in violation of Rule 5. Mr. Barnes could not answer this <br />inquiry. <br /> <br />Mr. Brian Goodman, 661 Springmill Drive, Mooresville, <br />Indiana inquired if the tree line behind his property would <br />be removed for this development. Mr. Holloway stated there <br />are no plans to remove trees or fencing. <br /> <br />Ms. Rea Robinson, 23 Wilson Drive, Mooresville, Indiana <br />stated that the lot owners in Rooker Trace already have <br />drainage problems and this development will not help the <br />situation. Ms. Robinson also expressed concerns in regard to <br />Neil Armstrong Elementary School being over crowded. <br />Mr. Holloway explained that Rooker Trace was platted prior to <br />the enactment of Rule 5; and the covenants and restrictions <br />"---- of Rooker' Run hold the builders responsible to enforce <br />Rule 5. The Plan Commission explained that the filing <br />procedures for a subdivision mandate that the school corpora- <br />tion be notified of all plat filings at the time of filing. <br />They advised all present that their concerns about school <br />over crowding be taken to the school board, as the town has <br />taken all steps possible to advise the school corporation of <br />proposed development in the school district. <br /> <br />Mr. Peter Burkhardt, 1388 Rooker Road inquired about the <br />traffic problem on Rooker Road. Street SuperIntendent <br />Joe Beikman explained that Rooker road is a county road and <br />all improvements on Rooker Road are the responsibility of the <br />Morgan County Commissioners. Mr. Holloway stated that there <br />is a 50' - 60' right-of-way on Rooker Road which would allow <br />the county to widen the road. Mr. Holloway also stated that <br />the sidewalks will be 25 feet from the pavement. <br /> <br />~ <br /> <br />Mr. Pat Carroll, 1350 Rooker Road, Mooresville, Indiana <br />advised the Plan Commission that as an adjoining property <br />onwer he had not been notified of this hearing. Mr. Carroll <br />supplied the Plan Commission members with a hand out to <br />support his opposition to this development. Mr. Carroll <br />stated he does not feel this development is compatable with <br />the comprehensive plan due to the fact that the comprehensive <br />plan designates this area as low density and this development <br /> <br />-, <br />L <br />
