Mr. Carroll also advised the Commission <br />that lt is hlS feeling that the developer is trying to take <br />advantage of the Town by filing this development as a <br />Planned Unit Development and not a subdivision. <br /> <br />The material Mr. Carroll submitted to the Plan <br />Commission is part of these minutes designated as attachment <br />C <br /> <br />Mr. Ralph Foley stated that to the best of his knowledge <br />all adjoining property owners had been notified of this hear- <br />ing as the developer had sent in excess of ninety notices. <br />Mr. Foley also stated that the reason for notification of the <br />hearing is to advise all effected property owners of the <br />hearlng to enable these property owners to be aware of the <br />public hearing, by virtue of the fact Mr. Carroll is in <br />attendence at this hearing he was aware of this public <br />hearing. <br /> <br />Mr. Holloway explained that the reason this development <br />was filed as a Planned Unit Development is due to the varying <br />lot sizes in the development, not to take advantage of the <br />Town as Mr. Carroll had stated. <br /> <br />Mr. Mike Underhill, 4 Vernon Drive, Mooresville, Indiana <br />'- advised the Commlssion that his lot in Willwood Subdivision <br />is in excess of one acre and he would like to know why the <br />Town does not mandate this size lots for other developments <br />in this ar'ea. <br /> <br />Mr. Darrell Swinney of Swinney Brothers Excavating ex- <br />plained the cost of development prohibits one acre plus lot <br />sizes in a municipality. rhe cost of the infrastructure, <br />Mr. Swinney stated, makes one acre plus lot sizes not a <br />reality in this area. <br /> <br />Motion was made by Bill Abbott, second by Tim Bennett <br />to recommend approval of a zoning change from agriculture <br />to PUD-R for Rooker Run Subdivision to the Mooresville Town <br />Council. Motion passed 6 in favor, 1 abstention. Commission <br />member Steve Edwards abstained due to the fact he had <br />temporarily excused himself from part of the hearing and did <br />not hear all of the petition. <br /> <br />Mr. Ross Holloway appeared before the Mooresville Plan <br />Commission representing Swinney Brothers requesting final <br />plat approval for PUD-R zoning for Collett Acres Subdivision <br />which is part of NW/4 T13N R2E Sec 33 containing 41.643 <br />acres. <br /> <br />'-- <br /> <br />3 <br />
