<br />Chapter Ten Piling Procedures <br /> <br />Section I. <br />1. Notice Procedure For All Public Hearings. All petitions <br />before the Mooresville Board of Zoning Appeals and Plan Commission <br />shall be filed in triplicate at the Clerk/Treasurers Office at <br />least ten days prior to the date of public hearing at which the <br />petitions are to be heard and must be on file prior to the date <br />any public notices are sent out. <br />a. Notice of Publication. Legal notlce in a newspaper of <br />general circulation in the Town of Mooresv~lle shall be published <br />at least ten (10) days prior to the hearing date an proof of <br />µublication shall be made by an affidavit of the publisher <br />attached to a copy of the notice taken from the paper in which it <br />was published. Such affidavit shall include the name of the <br />newspaper and the time of publication. Proof of publication shall <br />be returned to the Plan Commission five days prior to the public <br />meeting. <br />2. Notice To Adjoining Land Owners: Additional notice shall <br />be given to all adjoining landowners who are within two parcels in <br />depth or six hundred sixty (660~ feet form the subject property, <br />whichever is least. Such notification shall be ~ade at least ten <br />(10) days prior to the hearing date and be made 'be certified or <br />registered mail. For purposes of this notice requirement, where <br />any of the adjoining parcels of 'ground are owned by the <br />petitioner, the subject property shall be deemed to include such <br />adjoining land owned by the petitioner. <br /> <br />For the purpose of determining the names and addresses of the <br />legal adjoining property owners the records in the bound volumes <br />of the most recent tax assessment records as they appear in the <br />offices of the Morgan County Auditor shall be deemed to be the <br />true names and addresses of persons entitled to be notified. <br /> <br />Such notice shall state: <br />(1) The location and legal description of the land involved in <br />the petition. ' <br />(2) That the petition may be examined in the Mooresville Town <br />Hall. <br />(3) The docket number and the specific request set out in the <br />petition (in the event it is a re-zoning the specific type of <br />classification being requested, and in the case of a variance, <br />special exception or other public hearing the specific request <br />being petitioned for). <br />(4) The time and location said petition has been set for public <br />hearing along with the Board the Petition will be heard by. <br />4. Affidavit of Notice. The Petitioner shall furnish evidence of <br />compliance of the notice requirements .by fiiing a notarized <br />statement with the Board or Commission as is appropriate. Said <br />notice shall list names and addresses of the property owners to <br />whom the notices were sent out and the return receipts of postal <br />registrations shall be attached to the affidavit in the same order <br />as the property owners are listed on the affidavit and returned to <br />the Clerk/Treasurer's office at least five days prior to the <br />Public Meeting. <br />
