MINUTES OF THE MOORESVILLE PLANNING COMMISSION

'--

The Mooresville Plan Commission met for its regular meeting on July 25,

1991 at 7:30 P.M. at the Mooresville Town Hall. Present were members Joel

Beebe, David Minardo, Charles McGuire, Vern Kimmel, Steve Edwards, William

Abbott, Shirley Welker and Signe Nicholson. Absent was member David Barry.

Also present was the Commission's attorney, Timothy C. Currens.

Joel Beebe informed the Board that there was a change in the minutes on

page 2 paragraph 8. The word Quorum has been changed to majority. Steve Edwards

made a motion to approve the minutes. A second was made by Bill Abbott. Motion

passed unanimously.

OLD BUSINESS

Mark Peden, attorney, came before the Commission representing Swinney

Brothers Excavating, Inc. and their request to rezone from A to RI. At this

time Tim Currens requested that it go on record that he has represented Swinney

~ both in the past and present; therefore, he asked to be excused from any discussion.

Mark Peden said this area has been designated for future growth and Mr.

Swinney has met with many of the neighbors to clear any differences. The

developer has also met all the requirements of the Ordinance.

Bill Abbott asked if the developer will have a water supply and be on

city sewers. Mark Peden answered yes. Signe Nicholson then asked if anyone

close to this area yet outside the city limits could be included on the utilities

and Darryl Swinney answered it would be available.

Darryl Skipworth, 511 Landersdale Road, spoke on behalf of several others

in the area. He said they were not necessarily opposed but felt there should

be restrictions and asked that the requirements on the lots be 20,000 sq. ft.

and 1250 sq. ft. on the homes.

Mark Peden responded by saying that there were larger lots and that Swinney

was complying with the Ordinance and its requirements. Darryl Swinney went on to

say that the reason lots were larger in the past was to accommodate septic

systems.

Bill Abbott said that he felt the Comprehensive Plan developed two years ago

- 1 -
