is a good guide and the size of the lot, house and price is not the issue here.
'-"

The issue is the developer meeting the requirements of the Plan and he did not

see how we could deny this request.

Signe Nicholson said that she agreed but felt that it would behoove the Plan

Commission to listen to the concerns of the people. When the Plan was developed

it was to be reviewed and changes were to be made to keep it current with the

growth.

Bill Abbott said he agreed but at this point it would be unfair to turn

down this developer who is meeting the requirements of the Plan as it is now.

Signe Nicholson then asked if we grant Rl and the plat meets by law the lot

size but not what the neighbors want, doe we have the right to determine higher

standards. Steve Edwards said that was the whole point of the Plan and did not

see how they as a Board could change at this time. Bill Abbott said he would

hate to see this Board have to redesign each plat for each developer. Steve

Edwards wentl".ün to say that the Plan was developed to have some consistency

with other areas and not have hodge podge. Just because they are smaller lots

does not mean they are not going to be nice homes.

Bill Abbott made a motion that the Planning Commission recommend to the Town

'-"
Council to accept the petition to rezone from A to RI. A second was made by

Charles McGuire. Motion carried 5-2 with Shirley welker and Signe Nicholson

voting Nay and Vern Kimmel abstaining.

Bill Abbott then made a motion that discuss and vote as to whether we will

change the restrictions. A second was made by Shirley Welker. After further

discussion Bill Abbott asked to recind his motion and then made a motion that

we proceed with the second rezone request. A second was made by Signe Nicholson.

Motion carried unanimously.

Ralph Foley then carne before the Commission representing Environmental

Development Corporation and their request to rezone 80.24 acres on Rooker Road

from A to R2.

Debbie woods, realtor, again presented the Commission with statistics on

taxes, utilities, etc.

Norm Taylor, 920 S. Johnson Road spoke on behalf of several of his neighbors.

He said the Ordinance falls short of other counties and presented a petition

from the neighbors asking that the Ordinance be changed to consider the area

in the Buffer Zone.

Pat Carroll, 1350 Rooker Road also presented a petition signed by over 130

area residents. He said that another side of the coin is that although there

~

- 2 -
