<br />'-- <br /> <br />~ <br /> <br />~ <br /> <br />Signe Nicholson made a motion to recommend to the Town Council that we deny <br /> <br /> <br />the Rl Zoning for the entire 80 acres of the Comer property because it is <br /> <br /> <br />inconsistent with the Comprehensive Plan. A second was made by Shirley Welker. <br /> <br />Motion failed to pass with 2 voting yes and 5 nay. Vern Kimmel abstained. <br /> <br /> <br />Steve Edwards at this time brought to the attention of all parties present <br /> <br /> <br />that Signe Nicholson did in fact prepare the Comprehensive plan as was in fact <br /> <br /> <br />paid by the Town for her work. <br /> <br />Bill Abbott made a motion that we recommend to the Town Council to accept <br /> <br /> <br />the petition to zone the 80 acres in question to Rl. A second was made by <br /> <br /> <br />Steve Edwards. Motion passed with 5 voting yes and 2 nay ( Signe Nicholson and <br /> <br /> <br />Shirley Welker). Vern Kimmel abstained. <br /> <br /> <br />Mark Peden, ROSS Holloway and Darryl Swinney then presented the preliminary <br /> <br /> <br />plat maps to the Board for review. There were several items needed for the <br /> <br />final plat approval and these will be given to Ross Holloway (attachment). <br /> <br /> <br />Bill Abbott questioned the drainage design and Ross said the land is flat but <br /> <br /> <br />flows to the south and southeast which flows into a lake. There will be an <br /> <br /> <br />easement acress Lots 18, 19, 20, 21 and 46 for a detention basin. Erosion control <br /> <br /> <br />will be on the slopes and ditches. <br /> <br />Bill Abbott said he felt there needs to be some protection for silltation so <br /> <br /> <br />it does not reach lake property during construction. Darryl Swinney said they <br /> <br />have agreed to buffer mounds which the existing neighbors would like. These will <br /> <br /> <br />be shown on the final plat. <br /> <br />Bill Abbott made a motion to accept the preliminary plat approval as submitted. <br /> <br /> <br />A second was made by Vern Kimmel. Motion carried unanimously 8-0. <br /> <br /> <br />Ralph Foley, and Ross Holloway presented the preliminary plat on behalf of <br /> <br /> <br />Environmental Development Corporation. There will be a detention basin in the <br /> <br /> <br />north corner. It was also pointed out that they will need street grades and location <br /> <br /> <br />of storm sewers on the final plat. <br /> <br /> <br />Tim Currens told Ross Holloway that there will need to be something in the <br /> <br /> <br />covenants showing that a homeowner cannot fill the drainage detention area. <br /> <br /> <br />Bill Abbott asked if they have a water commitment and developers replied they <br /> <br /> <br />did not at this time but they will be working with Hoosier Water Company. <br /> <br /> <br />Steve Edwards made a motion to approve the preliminary plat subject to meeting <br /> <br /> <br />these requests. A second was made by Vern Kimmel. Motion passed 6-1 with <br /> <br /> <br />Charles McGuire voting nay. Shirley Welker abstained. <br /> <br />-4- <br />
