<br />~ <br /> <br />. <br /> <br />Joel Beebe moved to accept the preliminary planned unit development <br /> <br />on lot 36. <br /> <br />This was seconded by Dave Barry. <br /> <br />Bob Tucker requested <br /> <br />they work with the fire chief on the fire protection on this lot. <br /> <br />The vote was eight (8) in favor and zero (0) opposed. <br /> <br />The next item to come before the Plan Commission was the <br /> <br />petition for a minor plat and rezoning of Duane Gaddis. <br /> <br />Phil <br /> <br />Smith was present along with Dennis Gaddis the son of Duane <br /> <br />Gaddis. <br /> <br />Jeff Banning of Lewis Engineering was also present. <br /> <br />Phil <br /> <br />Smith provided the notice verification and proceeded with showing <br /> <br />the minor plat. <br /> <br />In particular, there were five acres shown on <br /> <br />the minor plat which was also shown for rezoning from A-I to R-l. <br /> <br />Steve Edwards questioned the location of the drive. <br /> <br />Phil Smith <br /> <br />pointed out the access. <br /> <br />Signe Nicholson asked if there were any <br /> <br />additional questions from the board. <br /> <br />Robert Tucker questioned <br /> <br />whether or not this was on a county road. <br /> <br />Mr. Smith advised <br /> <br />that there was access through a series of easements. <br /> <br />The first question then was the discussion by the board of <br /> <br />adequate access to allow the filing of the minor plat. <br /> <br />Alan Tutewiler, an adjoining property owner at 520 Park Drive <br /> <br />then addressed the board. <br /> <br />He stated that access to the house was <br /> <br />a problem since Mr. Gaddis had filed a suit and named the town <br /> <br />and his company along with G. R. Wood in the suit. <br /> <br />His fears <br /> <br />were that additional access problems would create additional <br /> <br />litigation for the neighbors. <br /> <br />He also questioned how many homes <br /> <br />would be back there and the suitability of housing this close to <br /> <br />industrial zoning. <br /> <br />proposed. <br /> <br />Signe Nicholson stated that one house was <br /> <br />~ <br /> <br />-3- <br />
