~

.

Randy Kelly of G. R. Wood then addressed the board. He

stated his concerns were the access to the property and he

presented photographs showing the access easement flooded in

May of 1989 and 1990.

Duane Gaddis stated that he had lived

back there since 1972 and had never spent a night outside of the

house due to flooding.

Signe Nicholson asked whether or not

there was a shooting range for the Mooresville Police Department

in the area. She further stated that in the event of flooding

that it could not be reached either. Mr. Kelly stated that he

felt that was correct. Signe Nicholson then asked Alan Tutewiler

what the specific problems with access were. He stated that he

had spent several thousand dollars and days in court over water

problems that Mr. Gaddis had experienced to his easement. He

stated that he would not want to have similar lawsuits to defend.

Duane Gaddis said the problem was now solved as far as he was

concerned since G. R. Wood had changed its drainage.

Robert

Tucker questioned if the problems were fixed where did it come

from in May when it was flooded.

Duane Gaddis stated that the

water does not stay up as long now.

Steve Edwards questioned the

buffering in this area from residential to industrial. Signe

Nicholson stated that the additional property owned by Duane

Gaddis would provide buffering along the five acres itself. She

felt that since the industrial area was in there first that no

buffering would be required of them. Robert Tucker stated that

anyone buying the property should be aware of the water problems

and what they might be getting into. Signe Nicholson questioned

how many days a year the area was flooded.

No one had an exact

.~

-4-
