Signe Nicholson asked if there <br />were any further questions from the Board or the floor. There <br />being no further questions, the Board proceeded with its <br />discussion. Robert Tucker stated that he felt the property should <br />be rezoned due to the nature of the business and how it fit in the <br />area. Steve Edwards made a motion to recommend to the Town <br />Council that the rezoning be approved. This was seconded and <br />unanimously carried. <br /> <br /> <br />The Board's Attorney advised that the Remster rezoning would <br /> <br /> <br />come next month due to irregularities in their notices. <br /> <br /> <br />The next item to come before the Board was the alleged <br /> <br /> <br />violation of the variance granted to David and Judy Chandler of 45 <br /> <br /> <br />E. High Street. This matter had been brought up at the last <br /> <br /> <br />meeting of the Board and a letter had been sent by the attorney to <br /> <br /> <br />the Chandlers requesting them to appear at the meeting. Mr. and <br /> <br /> <br />Mrs. Chandler were both present along with all of their operators <br /> <br /> <br />and Mr. Chandler proceeded to address the Board. In particular, <br /> <br /> <br />he stated that they shut down by 9:00 p.m. on a regular basis and <br /> <br /> <br />occasionally go on until 9:15 or later in the event of an <br /> <br /> <br />emergency. He also advised that a cleaning lady comes in on <br /> <br /> <br />Sunday mornings from 8:00 - 11:00. He also advised that he does <br /> <br /> <br />upkeep and maintenance on Sundays but no customers are present. <br /> <br />He stated that there was no type of portable sign on the property. <br />Mr. Chandler stated that they keep lights on at the property at <br />all times and have a mutual parking agreement with their neighbor, <br /> <br />-2- <br />
