<br />'-- <br /> <br />'--- <br /> <br />'--- <br /> <br />dldd)06 <br /> <br />Attorney advised that with the planned unit development being <br />approved, it would be necessary for any subsequent uses to come <br />before the Board of zoning Appeals and Plan Commission to amend <br />the planned unit development. Floyd Duncan of 177 North Indiana <br />Street then spoke and stated that there was a lot of water <br />retention in this area. All parties agreed that this was a <br />problem and that it was one that was not totally within the <br />control of the Raymonds since the water flowing in and through the <br />property was controlled by upstream and downstream channels. <br />William Abbott then moved to approve the planned unit <br />development to be consistent with Master Land Use Plan and to <br />recommend this to the Board of Zoning Appeals. This was seconded <br />by Steve Edwards and unanimously carried. <br />The next item on the agenda was the Caperton final plat <br />approval. There being no one present on this matter, it was <br />tabled. The next item was the status of the 39 1/2 West Main <br />Street property zoning violations. The Board's Attorney advised <br />that a lawsuit had been filed and that the defendants were <br />attempting to work out an agreed entry to correct the violations. <br />The attorney also gave the Building Inspector's report of 6 <br />permits and 4 inspections. <br />The Board then reviewed the zoning maps and, in particular, <br /> <br />the proposed classifications under the new ordinance.
