<br />,- <br /> <br />~5~D <br /> <br />Bill Abbott moved to approve the preliminary plat with the <br />understanding that all items which had not been placed on this <br />preliminary plat to be shown on the final plat. This was seconded <br />and unanimously approved. <br />Chairperson Beebe then opened up nominations for the Chair <br />for 1990. Vern Kimmel nominated Signe Nicholson; this was <br />seconded and unanimously approved. Nominations for vice- <br />Chairperson were then opened with Dave Barry nominating Robert <br />Tucker. This was seconded and unanimously approved. Nominations <br />were then opened for Secretary. Vern Kimmel nominated Shirley <br />Welker; this was seconded and unanimously approved. The meeting <br />was then turned over to new Chairperson Signe Nicholson. <br /> <br /> The next item on the agenda was the alleged violation at 39 <br />1/2 West Main Street. Herman Scott, who conducts a business at 39 <br />1/2 West Main Street, was present and explained the business he <br /> <br />conducted at the property. The Board's counsel then advised that <br />this had been an on-going problem and that he had spoken with Mr. <br />Scott on several occasions about the problems. In fairness to Mr. <br /> <br /> <br />Scott and the Board, Attorney Currens felt that a lawsuit should <br /> <br /> <br />be filed to request the Court to grant a restraining order against <br /> <br /> <br />any "junkyard" type use on this property. Attorney Currens also <br /> <br /> <br />advised that he would stand behind any general business use taking <br /> <br /> <br />place on this property since it was zoned for this type of use. <br /> <br /> <br />He further advised that any business violation taking place at the <br /> <br /> <br />residence of Mr. Scott at 101 South Street would be included in <br /> <br /> <br />the lawsuit. Mr. Scott agreed that this was fair, and Bill Abbott <br /> <br /> <br />moved that the Board approve the recommendation of counsel. This <br /> <br />-7- <br />
