~

mortgage was on another property with the proceeds being used on

the purchase of 125 E. High Street. Attorney Currens also
inquired as to receipt of the letter dated May 26, 1989 and
whether or not the allegations concerning the property being an
unsafe structure as itemized in the letter were correct. Mr.
Graybill stated that the notice of unsafe structure, pursuant to
the letter dated May 26, 1989 was timely received and that the
allegations were correct. Mr. Graybill's position was that he
only wanted additional time to get the property fixed. The
Board's Attorney also advised Mr. Graybill that in the event there
was an extension granted there was a risk involved in the event

that additional monies would be placed in the property with it

again not being completed sufficiently to correct all violations

and the Board acting to have the property removed after the

additional improvements were added. Mr. Graybill acknowledged an

awareness of this. Vern Kimmel then reemphasized this point,

advising him that in the event 30 days passed and the work was not

done, then the property would come down along with any

improvements placed in it during that 30 day period. In response

to that, Jerry Graybill stated that he wanted 30 days to prove

to Mr. Beikman that he is on the right track. Signe Nicholson

inquired of Mr. Beikman how much time would be needed to make the

corrections under normal circumstances. Mr. Beikman responded

that he felt the whole house could be built in 30 days. The only

problem that he could forsee would be rain which would interfere

with reroofing the structure. At this point, Chairman Beebe asked

for a motion. william Abbott made a comment, stating that he was

-7-
