Upon request of the Board, the Board's attorney advised <br /> <br />that he would contact the Kenworthys to see if they were still <br />pursuing the matter. <br />The next item on the agenda was the petition of Halls <br />Freightway for a rezoning from Local Business to General Business <br />on the property located just south of the bridge on State Road 67. <br />Halls Freightway was present by Rick and Ann Hall, along with <br />their attorney, Dave Lawson. Mr. Lawson advised that they had <br />been before the Board prior to this and requested that all of the <br />exhibits from the initial hearing be made a part of the record for <br />this hearing. The Board's attorney acknowledged that the file <br />from the June 2nd hearing had been pulled and all exhibits from <br />remonstrators and the petitioner were incorporated into this <br />record. Mr. Lawson advised that their prior request for <br />Industrial Zoning had been denied, and after the use determina- <br />tion was made by the Board of Zoning Appeals, this petition was <br />being brought for a General Business zoning classification which <br />they felt was the highest and best use of the land and that it was <br />compatible with other uses in the area, naming other similar uses <br />and their locations. He also advised that since it was off a <br />four-lane highway, that this certainly would be a logical busi- <br />ness use and that it shouldn't affect the Charmil Addition, due to <br />sufficient buffering. He also stated that the Town's economic <br />development director still felt that this was a proper use. <br />Mr. Lawson stated that he felt that the proposed use would not <br />interfere with the farming operation of Mr. Adams and would not <br />have an adverse effect on any of the surrounding properties. <br /> <br />-3- <br />
