Steve Edwards moved to recommend to the Town

Board that the property in question be rezoned from its present classification

of local business to general business. The motion was seconded by Warren

Franklin and unanimously carried.

The board then moved on to the next item under new business which was

the rezoning application of Cecil and Vida Rogers to rezone property located

at 201 East Washington from residential to industrial. Vice Chairman

Vern Kimmel indicated that this was another tract of land which was overlooked

at the time of the passage of the new ordinance. The Board found no one

present on behalf of the petition. The Board then moved to table the matter

until the.,next meeting.

The next item on the agenda was the request by Tom Lloyd and

Allen Tutewiler to accept for filing the preliminary plat of Woodlawn

Hills ,Subdivision. Present representing the petitioners was Thomas Lloyd.

He advised that the property in question was across from Hopkins Sand and

Gravel Pit. He further advised that there were sewage and city water

hookups presently available for that subdivision. He said that the final

product will be similar to Raesta Estates. The Board then went through the

ordinance to determine whether the preliminary plat met with the requirements

set forth in the subdivision control ordinance. The Board first determined

that the plat showed a set-back on the street of twenty-five feet and that

the ordinance required a minimum of forty feet. The board advised that

there needed to either be a variance to allow for the shorter distance or

to revise the plat to meet with these requirements. The Board further

found that the plat did not show the source of title to the land to be

subdivided as shown by the books of the Morgan County Recorder. Further,

the plat did not show the dimensions of the corner cuts. The Board also

'"-,

- 4 -
