Attorney Currens advised that he would like to have the Board review <br /> <br />the zoning maps and proposed changes in the zoning ordinance at the February <br /> <br />meeting with a public hearing in order that the Plan Commission might make a <br /> <br />recommendation to the Town Board on the same. The Board then went on to <br /> <br />discuss changes within the ordinance and reviewed all such changes including: <br /> <br />a new zoning classification of professional business and its related affect <br /> <br />on proposed uses. The Board also discussed changes as to mini barns, satellite <br /> <br />dishes, variance procedure, fences, and accessory buildings. The changes were <br /> <br />noted and a draft was to be prepared so the ordinance could be presented at a <br /> <br />public hearing at the next meeting. <br /> <br />The next item to come before the Board concerned a letter from Lee Comer, <br /> <br />attorney at law in Danville, Indiana. Mr. Comer had sent a letter to Attorney <br /> <br />Currens requesting the Board's interpretation of Indiana Code 16-13-21-12 which <br /> <br />deals with residential facilities for the developmentally disabled. The Board's <br /> <br />attorney advised that this statute in effect prohibited any zoning ordinance <br /> <br />from excluding such facility in a residential area unless the residential facility <br /> <br />would be located within 3,000 feet of another residential facility. Attorney <br /> <br />Currens advised that they were inquiring about this since they have looked at <br /> <br />two or three locations in Hooresville, including 59 South Clay Street, which is <br /> <br />where Steve Harris, law partner of Attorney Currens, resides. After a brief <br /> <br />discussion the Board concluded that they would prefer this type of facility to <br /> <br />be on a street which is not a row of houses in a totally residential area, <br /> <br />however, acknowledge that they had no control of this under the law and would <br /> <br />-3- <br />
