Notices were found to be in order and the request for the <br /> <br />property located at 1119 North Indiana Street from its present classification <br /> <br />of single family residence to multi-family residence was presented by Lon Milburn. <br /> <br />Mr. Milburn stated that he and Mr. Hill intend to purchase said property if it is <br /> <br />rezoned to build a duplex on the back side of said property and keep the current <br /> <br />structures in existence. In addition it is their intent to clean up the current <br /> <br />structures. Chairman Edwards asked how much ground was available. Mr. Milburn <br /> <br />responded that just under 2 acres of ground was involved. The Board opened up <br /> <br />the discussion to remonstrators. <br /> <br />Dr. J. R. Jones, the pastor of the Baptist Church located at 1117 North <br /> <br />Indiana Street, then spoke. He stated his property was just east of the property <br /> <br />in question and was requesting clarification. In particular he wanted to know <br /> <br />if multi-family zoning was allowed could additional units be placed on the ground. <br /> <br />---- <br /> <br />The Board's Attorney advised that only if a variance was granted and all other <br /> <br />qualifications of the town's zoning ordinance was met. In particular, for <br /> <br />additional units to be placed on this and before any additional unit could be <br /> <br />placed on the land a variance would have to be obtained for the reason that the <br /> <br />land was being subdivided by the Town's ordinance's definition. The only way <br /> <br />to avoid a variance would be to tear down the existing structure and place one <br /> <br />structure on the ground. <br /> <br />John E. May of 101 Dunn Drive then addressed the Board. He had questions <br /> <br />about what other requirements would be needed before additional structures could <br /> <br />be placed on the ground and felt that this had been answered. Gary Mullinex felt <br /> <br />that once this property had been rezoned that the owners would be home free to do <br /> <br />what they wanted with the property and that this could hurt the property value of <br /> <br />the church. There was further discussion by the Board regarding the placement of <br /> <br />'-- <br /> <br />a driveway and location of the proposed double and use of the other existing structures. <br /> <br />Chairman Edwards then stated he would entertain a motion. William Abbott moved that <br /> <br />the Plan Commission recommend to the Town Board of Trustees that the property be <br /> <br />-3- <br />
