'-

'--

'-

-2-

would be too great an encroachment on the residential neighborhood. The

question: was also raised that if this was rezoned as business or local

business could the residence located on that property be used as a residence.

Attorney Ksenak responded by saying that so long as that property continued to

be used as a residence that it would be considered a non-conforming use but

that if that property ever ceased to be used as such there would have to be an

application for a special exception to again use it as a residence.

Mr. Adams reiterated that he simply did not want to start a new corridor

of expansion and would fight any attempt to further expand the commercial business

into the residential area.

Mrs. Adams asked about access to the parking lot and her attention was

directed to the map which was prepared by the petitioners. Mr. Vinton indicated

that he felt there was sufficient space between the one story frame house on his

property and the adjoining neighbor's property to allow for access to the parking

lot. Mr. Adams indicated that there would have to be a street cut and Bill Abbott

responded that they were not here to make that determination but that the Vintons

would have to get approval from the Town Board for an alteration to South Street.

No further comments coming from the floor, Steve Edwards asked for comment

from the Board. Tilford Bailey felt that the residential district should stay that

way and agreed with Horace Adams that there should not be any further encroachment

into that area. He felt that a variance would be sufficient for the purposes stated

by the Vintons.

Bill Abbott said that the zoning behind the Kentucky Fried Chicken structure

goes back two lots to the alley and that this zoning completes the corridor and

actually the lot in question only goes back l~ lots and not a full two lots.

Bill Abbott moved to grant the petitioners request to rezone the property

located at 17 E. South Street from its present classification from residential to

that of local business. The motion was seconded by Vernon Kimmel. Steve Edwards
