<br />-2- <br /> <br />The Board then proceeded to the next item on the agenda, that being the <br /> <br />unsafe building alleged violation of Jerry Graybill. Mr. Graybill was present <br /> <br />in person and Building Inspector Beikman proceeded to advise the Board that with <br /> <br />the exception of the building being secured the alleged violations had been cured. <br />Mr. Graybill stated that the necessary door and door plate had been purchased <br />and would be functioning by this coming Monday. Attorney Currens advised that <br /> <br />although the building had been worked on sufficiently to take care of most of <br /> <br />the unsafe building allegations there was still some question as to whether or <br /> <br />not the work would meet code specifications and that Mr. Graybill might want <br /> <br />Building Inspector Beikman to take a look at the work just to protect him from <br /> <br />having to redo it. Mr. Graybill advised that he had already spoke to Mr. Beikman <br /> <br />and appreciated this information for the future. A motion was then made to dismiss <br /> <br />this cause of action upon the contingency that it was properly secured by October <br /> <br />28, 1985. The motion was duly seconded and unanimously carried. <br /> <br />The next item to come before the Board was the application filed by Robert <br /> <br />and Sherry Stewart docketed number 5 - 1985, said petition requesting the rezoning <br /> <br />of a 10 acre tract which fronts on Old Highway 67 from Residential to I-Industrial. <br /> <br />Mrs. Stewart was present along with realtor Jim Vandenbark. The attorney advised <br /> <br />that the notices were in order and Mr. Vandenbark proceeded to present the petition. <br /> <br />In particular he advised that the 10 acres was marked in red on the maps he handed <br /> <br />out to the Board and that access would be obtained off Old State Road 67. It was <br /> <br />also stated that the purchase of the property was contingent upon the purchaser <br /> <br />obtaining access off Old State Road 67. Mr. Vandenbark then introduced Mr. <br /> <br />Cunningham who was the owner of a pre-cast concrete manufacturing plant which made <br /> <br />septic tanks, barriers, pre-cast manholes and other types of pre-cast concrete <br /> <br />products with their business being in Lowell Indiana. Mr. Cunningham advised that <br /> <br />it was not his intent to hurt the integrity of the adjoining property and went on <br /> <br />'- to advise of the nature of his business. In particular he stated that the operation <br /> <br />--' <br /> <br />was clean and does not create a lot of dust and traffic. He stated that there would <br />
