<br />'- <br /> <br />MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />The Board of Zoning Appeals of the Civil Town of Moores- <br />vil~met at a called meeting on Wednesday, April 12, 1978. The <br />following Board members were present: Mr. Ray House, Mr. Paul <br />Walters and Mr. Steve Edwards. The attorney for the Board, Mr. <br />David E. Lawson, was also present. <br /> <br />Mr. Steve Edwards as Chairman of the Commission, called <br />the meeting to order. He advised the Board that by reason of <br />the fact that he was notified as an adjoining landowner con- <br />cerning the petition that was to be heard by the Board, that <br />he chose to disqualify himself to hear the petition. <br /> <br />Upon motion duly made, seconded and unanimously passed <br />by the Board, Mr. Tilford Bailey, a member of the Mooresville <br />Plan Commission was chosen as an elector to act as a member of <br />the Board of Zoning Appeals for hearing and determining the <br />petition which was filed as zoning Appeals Docket Number 1-1978. <br /> <br />Mr. Lawson, as attorney for the Board, found that the <br />notice requirement and contents of the petition were in order to <br />proceed with the public hearing as advertised. The petitioners <br />were represented by their counsel of record, Mr. John E. Mills. <br />There were no third parties appearing either in favor of or <br />remonstrating against the petition as filed. <br /> <br />After the presentation of the petition to the Board, <br />and after inquiry by the Board members, the following motion <br />was made by Ray House, seconded by Paul Walters and unanimously <br />passed: <br /> <br />I move that the petition for the variance be <br />granted personally to the petitioners, Carlton <br />and Mary Beth Worland,tomaintain and operate <br />in the existing building on the lower floor, <br />a 6-chair beauty salon. Pursuant to the petition <br />and plat thereof, the petitioners will provide <br />a parking area to the rear of the residential <br />property, which parking area shall be 55feet by <br />120 feet. Petitioners shall also be restricted <br />in that a business sign on the property shall <br />not exceed 30 inches by 48 inches. <br />
