<br />"--' <br /> <br />"\ <br /> <br />Mooresville Plan Commission <br />January 21, 1974 <br /> <br />The Mooresville Plan Commission met in regular session on <br />January 21, 1974, at 7:30 P.M. Those members present were: <br />Steve Edwards, Bart Hensley, William Roberson, Eweather Stephens, <br />and one of our new members, Lewis Truax. <br /> <br />Mr. David Lawson, attorney for the Plan Commission was also <br />present. <br /> <br />Minutes of the last regularly scheduled meeting were read <br />and approved. <br /> <br />There was no old business to come before the Plan Commission. <br /> <br />Thereafter, the ccmmission heard the following petition for <br />re-zoning: <br /> <br />Petition No. 7 ,1973 by SAC Development Co. to re-zone <br />from Class A Residential to Gen. Business. Petitioner AllEn <br />Lieberman for Chalfic [. AS50ci2tes ~evelrp01- J \,2S rr~r~~~~t~cl <br />by Attorney Steve McElwain. <br /> <br />Attorney for the Plan Commission, Lawson noted that proper <br />publication of notices of intent'were made, all adjoining property <br />owners had been duly notified. None of the adjoining property <br />owners appeared to re-monstrate, however, a letter from the Supt. <br />of schools, Wm. Curry was read, not necessarily as an objection to <br />~ the proposed re-zining for a shopping center, but asking that the <br />safety of school children at Neil Armstrong Elementary School, which <br />adj,ins the tract of land to be re-zoned, be considered and the <br />Aesthetic values of the School property not be violated. <br /> <br />Attorney McElwain and Allen Lieberman presented tenative as <br />well as speculative plans for a shopping center to be built on <br />17.39 acres of land bounded by Hadley Rd" Neil Armstrong Elementary <br />School, Kendrick Memorial Hospital and the Justin Property. <br /> <br />Drainage prOblems were discussed and a Topographical map drawn <br />by Mr. Delbert Hobson, who was also present, was presented. Mr. <br />Hobson stated that based on the present terrain there is little <br />likelihood of drainage problems developing. However, if the present <br />terrain is altered through excavation, etc. no one can be sure. <br />Mr. Hobson did strongly advise a deceleration lane leading off State <br />Rd. 67 onto Hadley Rd., to minimize the possibility of rear-end <br />collisions of traffic approaching the shopping center fromthe South <br />and possibly a turning lane for South~ound lanes of St. Rd. 67. <br />Mr. Hobson pointed out though that this is under County jurisdiction. <br /> <br />After consulting the Zoning Codes for Local Business and Gen. <br />Business and some general discuss-Ion of the guidelines for both <br />categories, Mr. Lieberman was asked why the shopping center, as <br />proposed, could not as well operate under a Local Business Zoning, <br />which is a lessor, but adequate Zoning for their proposal. It was <br />pointed out that variances can be sought and granted as the need <br />arises and thus the Town of Mooresville will be protected in the <br />event the proposed shopping center venture does not materialize. <br /> <br />- <br />
