<br />r <br /> <br />, <br />I <br />f <br />i' <br /> <br />MOORESVILLE PLAN COMMISSION <br /> <br />Stated Meeting of October 15, 1973 <br /> <br />The Mooresville Plan Commission met in regular session on Monday, <br />October 15, 1973 at 7:30 P.M. Those members present were Mr. Steve <br />Edwards, Mr. Henry Gajderowicz, Mr. Rich Keller, and Mr. Bart Hensley. <br /> <br />The meeting was called to order by the Chairman, Mr. Steve Edwards. <br />The minutes of the last meeting were not read by reason of the absence <br />of the Board's secretary, Mrs. Eweather J. Stephens. <br /> <br />In absence of the secretary, the Chairman requested that Mr. Henry <br />Gajderowicz record the minutes of the meeting. <br /> <br />There was no old business to come before the Board. <br /> <br />{ <br /> <br />Thereafter, the Board heard the following petitions for rezoning: <br /> <br />1. Petition No. .y ,1973 by Benjamin R. Mendenhall. Petitioner <br />was represented by Attorney John Mills. It was noted by the Board's <br />attorney, David E. Lawson, that the notice of the hearing for rezoning <br />had been published as coming before the Mooresville Board of Zoning <br />Appeals. It was the opinion of the attorney that whereas the time and <br />place of the hearing for rezoning was correct and that upon repre- <br />sentation of Mr. Mills, that the certified letters which had been sent <br />to adjoining land owners indicated that the petition was one for re- <br />zoning from residential to general business that the Board could waive <br />this defect. On motion duly made by Mr. Henry Gajderowicz and seconded <br />by Mr. Bart Hensley and unanimously carried, the Board agreed to pro- <br />ceed with the hearing on the merits of the Mendenhall petition. <br />Evidence was presented by the petitioner and his counsel; there <br />were no remonstrators appearing opposing this rezoning. Mr. Rich <br />KEller moved that the Mooresville Plan Commission recommend approval <br />to the Town Board of the rezoning as requested in the petition which <br />was seconded by Mr. Henry Gajderowicz and unanimously approved by all <br />commission members present. <br /> <br />2. Petition No. # J , 1973 by Harold W. and Carolyn A. Estes. <br />Petitioners were represented by Attorney Steven Harris. <br />The petitioner moved to amend their petition of rezoning from a <br />single family to general business rather than industrial. The amend- <br />ment was premitted as the request for general business is a lessor <br />classification than the request of Industrial. <br />The petition was presented by Attorney Harris and the property <br />owner Ha ro 1 d W. Es tes . <br />No adjoining property owners appeered to remonstrate, however, <br />Mr. Richard Squire, whose mother owns property in the area appeared <br />and was heard. Mr. Squire indicated that he thought the situation <br />,-- would be better handled by a variance rather than rezoning although, <br />
